21.01.2022 I share the best article I have come across on the NSW Govt's proposal to replace stamp duty with a property tax. It's looking like it will be cheaper to opt to pay stamp duty up front than pay property tax indefinitely.

21.01.2022 What better time to market anti-virus activewear than in the midst of a COVID-19 pandemic? That's what Lorna Jane, a leading Australian women’s activewear brand thought. It made three virus protection claims for its range of sports bras, tights, leggings, tank tops and gym clothes: Its anti-virus activewear prevented and protected against infectious diseases. It launched its LJ Shield exclusive technology.... It had worked for two years to develop a chemical-free treatment that when applied to activewear, protects wearers against viruses and bacteria. Trouble was, it did not realise that when making health claims, it needed to comply with the Australian Therapeutic Goods Administration Guidelines. 17.01.2022 This article is about Virgin Australian Airlines, which appointed insolvency administrators on 21 April 2020, when its debt servicing burden became unsustainable. 142 out of 144 of its aircraft were under lease or finance at the time. Usually when an airline goes into liquidation, lessors and financiers will immediately repossess their aircraft and fly them away. ... But in these Covid-19 times, the Virgin aircraft financiers were in no hurry because no one was lining up to lease aircraft. So they decided not to repossess, but to request the insolvency administrator to deliver up the aircraft engines to its facility in Florida. The administrator refused because it did not want to pay the cost of delivery. The scene was set for litigation. This article reports on the outcome.

09.01.2022 Do you run a cash business? Cash businesses often come to grief because the partners start to fight, or because the Australian Taxation Office is on the case. In both cases, the business will be wound up and a liquidator will chase the directors personally UNLESS they take action. What action should they take? It may seem obvious but self-reporting the cash and coming to a payment arrangement with the ATO will save the business from winding up. For more, click on my article.

03.01.2022 VIAGOGO IN HOT WATER Rarely have I heard a Judge be so scathing about a party's misbehaviour as Justice Katzmann was about viagogo! This is a selection: "The representations were on an industrial scale for the relevant period." "Viagogo’s responses give it the appearance of being a company that is indifferent to the interests of Australian consumers and which prefers to elevate its own profit motives above those interests, even when on notice of the potential for harm being d...one. Viagogo’s corrective action [to change its website] was taken very late [some time after the delivery of the liability judgment] and for it was the legal equivalent of drawing teeth.
