Where possible the ATO will gather employment data from business Single Touch Payroll (STP) reporting, so now, more than ever it is crucial to get your STP reporting finalised. 09.01.2022 Another day, another government announcement and update from us!!!!! Attached are the notes coming out of the national cabinet meeting yesterday in respect to the Mandatory Code of Conduct in respect to SME Commercial Leases. I suggest that you have a good read and please come back to your accountant contact with any questions. Key points for me:... 1. Landlords must not terminate a lease for non-payment during Covid-19 period or reasonable recovery period; 2. Tenants must remain committed to the terms of the lease and material failures to abide by lease terms will forfeit any protections afforded under this code; 3. Landlords mist offer tenants proportionate reductions in rent payable in the form of waivers and deferrals, up to 100% of the lease value. The reductions will calculated in accordance with jobseeker turnover reduction principles. E.g. Turnover down 40% then lease is reduced by 40% during this period. 4. The rent reduction can be offered int two forms. 1. Waiver of lease amount or 2. Deferral of lease amount. The waiver of the lease amount should constitute at least 50% of the reduction unless mutually agreed otherwise. It may need to be greater than 50% if an amount less than this would compromise the tenants ability to fulfil their ongoing obligations under the lease agreement. 5. Any lease deferrals are to be repaid over the greater of: a. The balance of the lease term. Or b. 24 months. 6. Any reduction in statutory charges such as land tax, rates are to be passed on to the tenant; 7. Landlords should seek to share any benefit it receives due to deferral of loan payments in a proportionate manner with the tenant; 8. Landlords should seek to waive recovery of any other expense by a tenant under the lease terms during the period the tenant is unable to trade; 9. If repayments are required, they should be arranged in a manner that wont put the tenant under undue financial stress and commence after the Covid-19 pandemic has ended or the lease expires; 10. No fees, interest or charges can be added to a tenants account and landlords cannot pay themselves from a tenants security bond; 11. Tenants should be offered an opportunity to extend its lease term for a period equal to the waiver/deferral period; 12. Landlords will agree to freeze ant rent increases for the duration of the Covid-19 pandemic and reasonable recovery period. This does not include retail leaves based on turnover rent. 13. Where landlords and tenants cannot agree on leasing arrangements, the matter should be referred to an applicable state retail/commercial leasing dispute resolution process for binding mediation. To be clear, 31 May 2020 is the final date you can enrol for JobKeeper if you intend to claim for wages paid for JobKeeper fortnights in APRIL and MAY. However, it is not the final date for enrolling for JobKeeper payments if you later decide you are eligible for JobKeeper fortnights in the remaining months through to the end of September.
