When a job is quite physical component, its important to confirm the person has the strength and fitness to perform the tasks, not only to do the job but, more importantly, to do the job safely, without risking injury to themselves or others. 25.01.2022 Over the coming weeks, we are going to look at some common HR myths and help clear up any confusion around these misconceptions. Myth #1 - THREE STRIKES AND YOURE OUT Many employers believe they have to give three written warnings before they can dismiss an employee. ... Why this is a risky play: Even if you give 3 warnings before terminating someones employment, they may still have grounds to claim unfair dismissal, for example: If the written warnings are inconsistent with precedents set with other employees in the same workplace, If the written warnings are considered unreasonable or not warranting a warning If the timing between the warnings is significant enough, or If the warnings are unrelated or not related to the dismissal. This play can also be risky when an employer fails to dismiss someone for msconduct that poses a safety risk or serious risk to the reputation of the business. So, how many written warnings are needed? There is no magic number! In any case, the fair work ombudsman will be wanting to see that a fair process has been followed, and that any actions taken are reasonable considering all the factors of the case. In cases of serious misconduct, employees may be terminated without notice, however there should be an investigation in most cases, and the employee must be given an opportunity to explain their actions. If an employer is dealing with performance related matters, the employee must be advised of their inadequate performance, provided with clarity around expectations, and given an opportunity to improve with appropriate support and regular feedback. What can you do and how long is it until it can be assumed that your employee is definitely not coming back to work? While abandonment of employment is not an issue that arises very often, when it does, it can cause a great deal of anxiety and stress for an employer. In some cases, an employee not attending work could mean they've been involved in an accident, are dealing with a serious issue in their personal life, and in some cases the person may have died. When you look at it from that perspective, it's easy to understand that there are some actions to take to check on the welfare of your employee. 23.01.2022 UPDATE ON LEAVE ACCRUALS Today, the High Court of Australia has overturned a previous ruling regarding the entitlement to personal/carers leave for shiftworkers in the Mondelez v AMWU case. This means that there is now clarity around calculating leave entitlements for part time employees and shift workers who work longer than 7.6 hour shifts. ... The high court confirmed that the expression "10 days" in the Fair Work Act is equivalent to an employees ordinary hours of work in a week over a 2 week period, or 1/26 of the employees ordinary hours of work in a year. What we mean is to not take the easy options like:... - skip reference checks, police checks, medicals - ignore your gut feeling - hire someone who is a great fit for the biz but not the actual job that youre needing to fill We recently started recruiting and while we received some amazing applications and spoke to some incredible men and women, we havent found the right person for the role - yet. Theyll be worth the wait, we know this from experience. Its easy for business owners and managers to rush to fill a role and skip over these steps. We know that sometimes finding the right people for your team is HARD! Youre looking for someone who has - skills and experience required for the role - values alignment and personality fit for your team and clients - availability that matches your needs - is going to be reliable and hopefully stick around! There are of course other factors for each unique role, and business. The key is that if you make the "hard" choices - which might include saying no to someone who is ALMOST perfect - youll be rewarded with fewer issues managing a new employee. 20.01.2022 WHAT IS THE ROLE OF A SUPPORT PERSON? You may have heard of the term support person as this becomes more common practice in the workplace. A support person is someone who is able to provide emotional support to the employee during what might be a difficult meeting for the employee. ... Their role is to provide emotional support, but they cannot speak on behalf of the employee, ask or answer any questions, or join in on any of the discussions. WHY IT IS GOOD PRACTICE TO INVITE AN EMPLOYEE TO BRING A SUPPORT PERSON TO DIFFICULT MEETINGS As an employer, it is good practice to offer an employee the opportunity to bring a support person to any meeting related to performance management, disciplinary action, potential redundancy or investigation. If these meetings lead to a termination of their employment, and the employee then lodges an unfair dismissal complaint, the Fair Work Commission will assess whether the termination was harsh, unjust or unreasonable. During their assessment, they will consider whether there was an unreasonable denial of a support person at any discussions relating to the termination of employment. 16.01.2022 UPDATE The Fair Work Commission had introduced a Schedule I to several awards in response to the impacts of Covid-19 on many industries. In the Restaurant Award, Schedule I provides award flexibility during the during the coronavirus outbreak, in relation to: employees classifications and duties... full-time and part-time employees hours of work taking annual leave. The Schedule was added to the award on 31 March 2020 and was initially due to stop operating on 30 June 2020. It has now been extended until 27 September 2020 and has been updated with the following changes from 1 July 2020: employees in the JobKeeper scheme are now excluded new conditions have been added for giving directions in relation to hours of work there are extra safeguards around directions to take annual leave provisions around close down have been removed. There have been several changes to Australian workplace laws in response to the Coronavirus pandemic and it can be hard to keep up with your current legal obligations as an employer! 14.01.2022 WHAT YOU NEED TO KNOW IF PLANNING TO CLOSE OVER THE CHRISTMAS AND NEW YEAR PERIOD Many awards and agreements allow employers to direct staff to take annual leave during a business close down period. If an employee doesnt have enough accrued annual leave, they can take unpaid leave or an employer may agree to pay annual leave in advance. ... If you are planning on closing over the Christmas period or planning to shut down a part of the business, its importnat to check if there are any specific requirements under the award that covers your business. Some awards require employers to give workers 3 months notice of a planned shutdown, others state 4 weeks and others are not as specific. Giving notice of a planned shutdown may need to be done in writing - again depending on the award. If you have a regular annual shutdown, its beneficial to include this in policies and employment contracts, and let people know during the onboarding process so there are no surprises. We recommend providing employees with written notice that covers - the exact dates of the closure - which roles/teams are impacted - any expectations leading up to the closure, e.g. completing projects, emptying the fridge! - available leave entitlements and options for taking unpaid leave Dont forget to mention keeping safe and enjoying the break! This ruling essentially highlights the need to ensure your casuals are true casuals. If you have casual workers, check the regularity of their shifts, and the likelihood of ongoing work. 13.01.2022 Job interviews can be a daunting experience for both the applicant and the employer. Many people don’t realise that there are things you can and can’t say during an interview. Knowing what is and isn’t acceptable is a good idea so that you don’t get yourself in some serious hot water!... Stick to questions that directly relate to the role, like: - Are you able to travel for work if required? NOT - Do you have children? - Do you have any limitations on your availability for Sunday shifts? NOT - Do you go to church on Sundays? - What are your longer term career plans? NOT - Are you planning on having children in the next year? It's important to avoid anything that may be considered discriminatory, because if you decide not to progress a candidate through to employment, they may have grounds to claim discrimination on the basis of the questioning. 11.01.2022 HR MYTH #4 YOU CAN FIRE AN EMPLOYEE FOR ANY REASON DURING THEIR PROBATION WITHOUT LEGAL RISK This is a widespread HR myth that is more incomplete than outright incorrect. While there is far LESS risk of an unfair dismissal claim being successful if an employee who is terminated during their probation period was to make a claim, there is still a risk. 06.01.2022 Under most Modern Awards, casual employees are entitled to what is known as a ‘casual loading’. This is an additional amount (often 25%) on top of the minimum hourly rate and factors in the absence of paid leave and other entitlements. Even though casuals already get a higher pay rate, if your casual employee works overtime, they need to be paid overtime rates instead of or in addition to their casual hourly rates. ... How this is calculated can be a nightmare for employers to work out. As part of their 4 yearly review, the Fair Work Commission has made some changes that come into effect from 20 NOVEMBER 2020 to clarify the way these rates are to be calculated. There are 3 different ways these overtime rates are calculated for casuals, depending on the award: overtime penalty rates payable instead of casual loading casual loading and the overtime penalty rate added separately to the minimum hourly rate, OR the overtime penalty rate applied to an ordinary hourly rate (the minimum hourly rate and the casual loading) If you employ casuals that work overtime, it's important to check the Award and make sure that any system changes, rates and payments are updated from the first payrun on or after the 20th of November 2020. 04.01.2022 HR MYTH BUSTERS! HR MYTH # 6 Have you ever worked for free, on a work trial, in order to get a job? Unpaid work trials are pretty common, especially in hospitality and retail. Many people think you can get someone in for a trial shift or 2, or 3 until you work out if theyre right for the job or not. This is a big HR MYTH!!! ... Unpaid work trials are not always lawful AND its important to know the limits of what you can and cant expect from a work trial. Free work trials are ok if theyre purely for the purpose of assessing someones skills and suitability for the role. This means they need to be supervised and the trial can only be as long as is needed to demonstrate their skills, i.e. an hour or, if its a more complex job, the length of a short shift. If the person is asked to come back to continue the work trial, or spends a long time on a work trial, or is asked to perform work unsupervised, it can be considered more like an employment arrangement. As an employee, they would be entitled to the minimum rate of pay and entitlements. The person is more likely to be considered an employee if youre requiring the person to work unsupervised; theyre doing productive work that would otherwise be done by an employee; theyre working a trial shift that is longer than a few hours; theyve already demonstrated the skills required for the job; or you ask them to return for a second trial shift.
