15.01.2022 Being a party to a family law proceeding can be difficult and painful. Whilst it may be second nature to reach out to your friends on Facebook, Instagram, or Twitter in difficult times, doing so during a family law proceeding can lead to some very poor outcomes. Under section 121 of the Family Law Act 1975, any person who publicly publishes content that identifies a party or any related person to family law proceedings is committing a criminal offence: the maximum penalty is ...1 year in prison. If you have made words or images available to the public (or a section of the public) either online or via other means, you will be considered to have published that content. This includes posts to Facebook and other social media platforms, even when you are only providing themto close friends. For the content to cause you to be liable under section 121, it has to identify a party to the proceedings. Publications that identify a party includes content that contains the party’s: name, pseudonym, or title; address; workplace; physical description; relationship to other identified persons (i.e. if you identify yourself and discuss your ex-partner, you may be inadvertently identifying them); and recreational, religious, or political interests.
