21.01.2022 Does your business operate or administer a Facebook page? If so, you could be liable for any third party defamatory comments that appear on your page. A recent NSW court decision (Voller) found that media companies were legally the publishers of comments on their Facebook page and therefore liable for the defamatory comments posted by their third party readers. This case highlights that businesses with a social media presence have an obligation to consider monitoring their sites content and comments or risk being found liable for the defamatory comments of another.

03.01.2022 Personal insolvencies across Australia continue to fall with the latest statistics revealing a 20.1% decrease in the June 2019 quarter for new personal insolvencies compared to the same period last year. Annually across Australia the drop is 15.1% taking annual bankruptcies to a 24 year low. There was a 22.1% fall in the number of new debt agreements in 2018/19 which was the first annual fall after seven consecutive increases. There are three types of personal insolvencies: bankruptcies, debt agreements and personal insolvency agreements. Debt agreements and personal insolvency agreements are legally binding agreements for somebody who is insolvent to pay their creditors an agreed amount. #bankruptcy

This new power came into effect on 21 February 2020 as part of the Governments broader strategy to reduce overdue tax, encourage engagement with the ATO, and improve overall transparency.

Businesses that were engaging with the ATO to resolve their tax debts would not be subject to the new rules.
