This can be exacerbated by discovering that you have been left out of the Will or that you have not received what you thought you would. On the flip side, if you are an executor of a Will, you may feel frustrated to find out someone wants to challenge the deceased’s wishes. You will then be required to defend those claims, which adds another layer of complexity. 22.01.2022 Verbal agreements or handshake deals as they are commonly known may be legally binding however, they can often lead to tricky situations, should a dispute arise. If the parties to a verbal agreement end up in a dispute, it is often challenging to prove these types of agreements, resulting in a he said, she said situation. We recommend that all contracts/agreements be documented in writing. This can include anything from loaning money to friend, agreeing to sup...ply goods on credit or an agreement between business partners. A shareholders agreement is a contract between the shareholders of a company, setting out the rights, obligations and liabilities of each person. It includes provisions such as the roles of the parties, how parties can buy-in and exit the company and how disputes are to be resolved. It is easier to negotiate a shareholders agreement at the start of a business venture (or soon after) when issues can be discu...ssed amicably, rather than when parties are frustrated by disagreements down the track. 10.01.2022 We were recently referred a client who’s business had taken a significant hit due to COVID-19. The director had numerous creditors chasing him, which was causing him and his family emotional and financial distress. We contacted his creditors to give him some time to assess his business and how to move forward. Once we had a plan in place, we then negotiated with the creditors to settle the debts. One in particular, where the creditor had already obtained a Court judgm...ent against our client, we managed to negotiate a discount of over $15,000. To this man and his young family, this was everything. To us, it was a true pleasure to assist a small business in a time of need. See more

01.01.2022 At the moment, we are seeing an increase of clients that are having difficulties with unpaid invoices. It is extremely frustrating when you’ve done your job and you don’t get paid. Here are some steps you can take to deal your debtors: 1Contact the debtor - have a chat with them directly to understand why your invoice hasn’t been paid. Ask them to pay the parts they don’t dispute, that way you can get access to some cash while you resolve the rest. ... 2Send a formal letter - one where you give the debtor a certain number of days to pay or you will take it further. 3Contact the debtor again - to make sure they have received your demand and ask what their position is. 4Contact a solicitor - sometimes a push from a solicitor is just what a debtor needs to pay.
