24.01.2022 Every builder, trades person and consumer should be worried about the recent decision of Chapel of Angels vs Hennessy Building Pty Ltd. The Courts found that Hennessy Building Pty Ltd held a low-rise builder and carpentry licence which did not permit him to carry out work on a Class 9B Assembly Building Type B Construction. Only a medium rise or open licence is permitted to carry out building on this class of building. The District Court ruled that the contract was unenforcea...ble and ordered that all the money paid by Chapel of Angels Pty Ltd. The District Court then ruled that the builder held a carpentry licence which allowed him to build just about all of the building and allowed the builder to make a claim for reasonable remuneration unaffected by section 42(4). The unenforceable building contract was $652,312.79 but the builder claimed $700k+ under carpentry work. On the 13th March 2017 QBCC issued Hennessy Building Pty Ltd with an infringement notice for acting outside of his builder low-rise licence and his carpentry licence. 12 months later Axia Litigation Lawyers engaged a quantity surveyor who presented as an expert and calculated all of the costs to build the wedding chapel and external work under his carpentry licence. The trades required to build the building and external work included: a. Concreting b. Termite Management c. Waterproofing d. Floor Finishing and Covering e. Roof Tiling f. Plastering g. Electrical h. Plumbing and Drainage i. Wall and Floor Tiling j. Painting and Decorating k. Building The decision of the District Court means that QBCC does not know their legislation and that a carpenter or any trade contractor can building any classification of building. This is of major public interest because the decisions of the Court of Appeal and the District Court sets a precedence for future unlicensed building disputes.
