24.01.2022 Dear VACC/TACC BRD Member, RE: TOMORROW A DAY OF POSITIVE CONSUMER ACTION IN VICTORIA AND TASMANIA As you are aware, the Australian Financial Complaint Authority (AFCA) made public this week, Case# 629915. ... I have attached the Case in PDF format. Please read the case it is very short and to the point. AFCA found: The insurer had to exercise its discretion under the policy reasonably and in good faith. AFCA considered that it would have been reasonable for the insurer to engage a qualified assessor to inspect the damaged vehicle to assess the reasonable costs of repair: a lower quote from another repairer was insufficient for this purpose. The insurer had not shown that the preferred repairer’s quote was, in fact, unreasonable and excessive. AFCA directed the insurer to pay the policyholder the amount quoted by her preferred repairer plus interest. Tomorrow is planned for a positive day of action advocating consumers rights be restored under their choice of repairer policyholder: A day of action is requested for tomorrow, and every single thereafter until full restoration of your customers choice of repairer rights and fair cash settlement. Tomorrow, we ask every single member, as support for customer rights, to hand to any vehicle assessor copy of the AFCA Determination if the insurer continues the practice of misconduct evident within Case 620915. It is VACC’s understanding that if AFCA further finds insurers are breaching consumer rights in the same way as detailed in Case 620915, the insurer can expect the same result. More significant penalties may be imposed for recidivist behaviour. Get behind tomorrow’s day of action, and every single day after, until customer’s choice of repairer rights and fair cash settling is restored. For your convenience, I have also attached the Choice of Repairer Information Chart, please refer to it when required.
