14.01.2022 BORDER FORCE POWERS TO SEARCH MOBILE PHONES The Australian Border Force can exercise wide ranging powers to stop and search persons entering Australian ports by land or sea; this extends to looking at material on mobile phones. Different rules apply to Commonwealth laws versus State Criminal Laws and the distinction is often not understood properly by lawyers or even Judges presiding over such matters.... If you need advice on Customs or Border Force penalties get in touch as we can help you get the best outcome and possibly get an acquittal or charges withdrawn. 13.01.2022 MAN STABBED BY WOMAN WIELDING HIGH HEELS When Kyle Johns, 19, headed out on February 23 to party with a friend in Brisbanes Fortitude Valley, he had no idea his night would end in the emergency room, getting staples in his scalp. As he walked down China Town Mall in the early hours of Sunday morning, he was suddenly approached by Jazzmin Fry, a complete stranger out celebrating her 21st birthday.... Fry then stabbed Johns in the head with her heel, leaving him bloodied and fearing for his life. Last week, Fry pleaded guilty to assault and a magistrate imposed a $250 fine with no conviction recorded. Its a result that has upset Johns, who feels like the punishment would have been far more severe if it was him who had attacked a woman. 10.01.2022 CORONAVIRUS COURTS The courts are racing to put in place technology for hearings to be done remotely. In terms of criminal and traffic law what this means is that persons who are not present in a court room will not be at risk of going to jail.... Bail applications will be able to be run on account of delays being encountered and persons are more likely to get bail granted. We further believe that there will be significant delays in police issuing charges as their resources are diverted and given the fact that police technology also needs to catch up to file documentation with courts remotely. In both the criminal and civil courts, we are rapidly moving to a position where appearances will be managed through the electronic and digital environment see: https://www.itnews.com.au//victoria-races-to-scale-up-virt We as a law firm available to give legal advice and to support the community continue to remain open during this period and if you have any inquiries in regard to criminal law or even other areas of law we are available to help you. There will be numerous challenges involving legal issues over this time and that is why we are here to help. I can be contacted here on Facebook message or by mobile direct 0410 639 921. 10.01.2022 DRIVER LICENCE DISQUALIFICATION MATTER This week I appeared in a traffic law matter at the Downing Centre in central Sydney. My client had been disqualified from driving until the year 2057 due to a number of offences and being declared a habitual traffic offender.... As new legislation has recently been introduced by the NSW government, a pathway now exists to make an application to the Local Court to get the disqualification removed. In consideration of my client completing a traffic offenders program, reconnecting with the community, increasing work opportunities and other factors, the court granted our application. Accordingly our client will be driving again shortly. Should you have any traffic law matters that you need advice on, message me here or call me now on 0410 598 740. 10.01.2022 COVID-19 DOMESTIC VIOLENCE Initial media reports and society sentiments suggested that domestic violence would rain and significantly increase, as a consequence of the COVID-19 restrictions. We are not seeing it to be frank and our views to explain why are, as follows: -... - pubs and hotels are shut curbing alcohol fuelled arguments and violence; - Police Stations are shut and Police resources are diverted to other matters; - economic pressures are such that people cannot afford to separate and so are pulling together more than ever, as people did in times before divorce became common place. For those apprehended violence orders that are proceeding and that we have appeared on the process has proven frustrating in some cases with long adjourned periods due to court closures; but in other cases matters have been more swiftly dealt with by Police resulting in apprehended violence orders being withdrawn. If you have any questions during this period in regard to apprehended violence orders or criminal law domestic violence matters get in touch with our Principal, Glenn Thexton on 0410639921 or here on Facebook by message. We are answering all your inquiries for free during this period in order to support the community as much as possible. 09.01.2022 DRIVING DISQUALIFICATION MATTER AT DOWNING CENTRE LOCAL COURT Today I represented a client in a driving licence disqualification matter. According to s221B(1) of the The Road Transport Amendment (Driver Licence Disqualification) Act 2017 Act, The Local Court may remove all licence disqualifications if the disqualified person has not been convicted of any driving offence for conduct during the relevant offence-free period which in todays case was two years.... Further, and according to Section 221B(2), The Local Court must take into account the following in determining whether it is appropriate to remove the licence disqualifications: a) the safety of the public, b) the applicants driving record, c) whether the applicant drove or was in a position to drive a vehicle during the relevant offence-free period, d) any relevant conduct of the applicant subsequent to the licence disqualifications, e) the nature of the offence or offences giving rise to the licence disqualifications f) any other relevant circumstances (including the applicants capacity to travel for the purposes of employment, business, education or training, the applicants health and finances and the availability of alternative forms of transport. After taking the Magistrate through the considerations as outlined above, our clients disqualification was removed. Accordingly he is eligible to drive again. 04.01.2022 As of 1 December 2019, mobile phone detection cameras have been put in place in NSW. For the first three months, If you are caught by these cameras, you will be issued a warning letter. Importantly, there will be NO warning signs to inform you that the cameras are operating in the area you are driving in. The same fine of $344 and five demerit points still applies for illegal mobile phone usage (not camera caught). Even if your phone is secured in a cradle, you can still be b...ooked for touching the phone. Dont have the phone on your lap, on your seat, or worse still, held in your hand. 02.01.2022 CORONAVIRUS AND BAIL APPLICATIONS. Coronavirus is impacting on the prospects for bail. Accused persons who have been refused bail previously are now being granted bail due to the issue of delay. Here is a case extract where Coronavirus has directly impacted on bail:... Re Broes [2020] VSC 128 (19 March 2020): [46]Given the extraordinary circumstances in which we now find ourselves, I have come to the conclusion that an already significant delay will be likely exacerbated by the consequences of COVID-19, and I am therefore satisfied that exceptional circumstances have been established. [39] there can be no question that once the virus is discovered in any of the Victorian prisons, there will have to be a significant lockdown for a number of reasons. The transmission between prisoners will be significant and likely to occur at a much greater rate than the transmission that is occurring in the community at present. That will result in a large number of prisoners becoming quite seriously ill, depending on their age and underlying conditions. I appreciate these are matters of speculation to a degree, but the situation is sufficiently urgent to required them to be taken into account. Further bearing in mind that the entire situation may have changed again within one or two weeks. I can be contacted here on Facebook message or by mobile direct 0410 639 921. We do not charge a fee for your initial inquiry so get in touch if you have any questions.
