18.01.2022 DANGERS OF USING MOBILE PHONES WHILE DRIVING Thousands of Australian drivers are still being caught using mobile phones while driving. The new cameras in Sydney are catching almost 1000 people a day.... Some have even been caught using 2 phones and not holding the wheel at all. We are now all aware of the dangers of using phones which distract our attention from the road. With the new cameras, more people will be detected and fined. In NSW, where the new technology is being trialed, fines will be implemented 1 month after the 3 month trial is concluded. However the risk is much greater as a collision can result in serious injury or death. You may also be charged with more serious offences which can result in prison sentences. 15.01.2022 CORONAVIRUS AND BAIL APPLICATIONS. Coronavirus is impacting on the prospects for bail. Accused persons who have been refused bail previously are now being granted bail due to the issue of delay. Here is a case extract where Coronavirus has directly impacted on bail:... Re Broes [2020] VSC 128 (19 March 2020): [46]Given the extraordinary circumstances in which we now find ourselves, I have come to the conclusion that an already significant delay will be likely exacerbated by the consequences of COVID-19, and I am therefore satisfied that exceptional circumstances have been established. [39] there can be no question that once the virus is discovered in any of the Victorian prisons, there will have to be a significant lockdown for a number of reasons. The transmission between prisoners will be significant and likely to occur at a much greater rate than the transmission that is occurring in the community at present. That will result in a large number of prisoners becoming quite seriously ill, depending on their age and underlying conditions. I appreciate these are matters of speculation to a degree, but the situation is sufficiently urgent to required them to be taken into account. 11.01.2022 EX FIANCE FABRICATES CLAIMS ABOUT PARTNERS ABUSE A web of lies and deceit spun by the woman who had promised to love him resulted in Mr Jones facing 20 years behind bars for crimes he did not commit. Daniel Jones met Sarah Jane Parkinson in 2011, and the pair quickly fell in love. Within just a few months they began planning a wedding and building their own home. ... However for months, Sarah Jane Parkinson had been feeding a story of heartbreaking abuse and violence to her police colleagues at Queanbeyan police station, where she worked as a clerical assistant. She told her police friends she was being brutally assaulted and abused by her fiance, Mr Jones. 09.01.2022 ENCRYPTED COMMUNICATIONS DRUG TRAFFICKING Encrypted messaging apps are more frequently being used by crime syndicates or people seeking to avoid detection for illegal activities.... What needs to be remembered is that despite the fact that encryption may prevent interception of messages and calls it does not necessarily prevent access to them on the actual mobile or computer device itself if the messages remain on the device or have been deleted from an app that is not encrypted. WHEN YOU DO NOT HAVE THE RIGHT TO REMAIN SILENT WA has the toughest laws relating to cannabis out of all States or Territories in the country. ... If you or your vehicle are searched, or you are present during the execution of s search warrant by police you do not have the right to remain silent. Police have the power to require you to provide information to them to enable them to target drug dealers and trace proceeds of crime. If a requirement to provide information is placed upon you by police, you are required to tell them any information that is within your power to give, in answer to any question that you are asked which is relevant to a drug related offence. You are required to provide this information to police even if it may incriminate you. Any information that you do provide cannot be used as evidence in a court of law. You still have the right to seek legal advice before speaking to police. If you refuse to answer, or provide information to police that is later found to be false or misleading you can be arrested and charged with an offence. The penalty is a fine of up to $3,000 or up to 2 years imprisonment, or both The only other State where police have a similar power is Tasmania. 06.01.2022 MEDICAL COMMUNITY RALLY AGAINST MANDATORY REPORTING OF COLLEAGUES The Queensland Government is attempting to strengthen the laws relating to the mandatory reporting of other health professionals. Under new legislation there will be an increased onus on those who treat clinicians for drug, alcohol and mental health issues.... We believe this use of the law may in fact have the reverse effect. Clinicians may continue to hide their issues and not seeking treatment if they are going to be reported. This will leave the treating practitioner facing the prospect of breaking the law if they choose not to report. 05.01.2022 MAN STABBED BY WOMAN WIELDING HIGH HEELS When Kyle Johns, 19, headed out on February 23 to party with a friend in Brisbanes Fortitude Valley, he had no idea his night would end in the emergency room, getting staples in his scalp. As he walked down China Town Mall in the early hours of Sunday morning, he was suddenly approached by Jazzmin Fry, a complete stranger out celebrating her 21st birthday.... Fry then stabbed Johns in the head with her heel, leaving him bloodied and fearing for his life. Last week, Fry pleaded guilty to assault and a magistrate imposed a $250 fine with no conviction recorded. Its a result that has upset Johns, who feels like the punishment would have been far more severe if it was him who had attacked a woman. 05.01.2022 DNA OF FAMILY MEMBER LEADS TO CONVICTION In an Australian first the South Australian Police have conducted a familial DNA search which lead to the investigation, arrest and conviction of an individual for sexual assault. DNA was taken from two crime scenes which did not result in a match with the National DNA database. ... A familial search was then conducted which resulted in a list of potential relatives from the database. A single child or parent, of the person who left the DNA, was identified as being the likely source. This is a new technique in Australia, that has been used in other jurisdictions around the world. 05.01.2022 AVO MATTER AT CAMPBELLTOWN LOCAL COURT This morning I appeared in an AV0 (Apprehended Violence Order) matter at the Campbelltown Local Court. I represented the Applicant in this private AVO matter involving intimidation, harassment and death threats in a sporting environment from one hockey mother to another.... The matter has been adjourned for six weeks in order for both parties to serve evidence on the other. 05.01.2022 DRIVING DISQUALIFICATION MATTER AT DOWNING CENTRE LOCAL COURT Today I represented a client in a driving licence disqualification matter. According to s221B(1) of the The Road Transport Amendment (Driver Licence Disqualification) Act 2017 Act, The Local Court may remove all licence disqualifications if the disqualified person has not been convicted of any driving offence for conduct during the relevant offence-free period which in todays case was two years.... Further, and according to Section 221B(2), The Local Court must take into account the following in determining whether it is appropriate to remove the licence disqualifications: a) the safety of the public, b) the applicants driving record, c) whether the applicant drove or was in a position to drive a vehicle during the relevant offence-free period, d) any relevant conduct of the applicant subsequent to the licence disqualifications, e) the nature of the offence or offences giving rise to the licence disqualifications f) any other relevant circumstances (including the applicants capacity to travel for the purposes of employment, business, education or training, the applicants health and finances and the availability of alternative forms of transport. After taking the Magistrate through the considerations as outlined above, our clients disqualification was removed. Accordingly he is eligible to drive again. 03.01.2022 LANE FILTERING ON ROADS The New South Wales Governments Towards Zero road safety campaign uploaded a video to its Facebook page last week about lane splitting. This is where motorcyclists scoot between slow moving or stationary cars. What is lane filtering?... Lane filtering is when a motorcycle rider moves alongside vehicles that have either stopped or are moving slowly (less than 30 km/h). Motorcycle lane filtering laws apply in NSW, with strict conditions. Motorcyclists must only lane filter when travelling less than 30 km/h. Motorcyclists can lane filter through stationary and slow moving traffic. Motorcyclists caught moving between traffic at over 30km/h face heavy fines and three demerit points under the offence called lane splitting It is illegal for motorcyclists to lane filter: next to the kerb next to parked vehicles in school zones Motorcyclists should not lane filter around heavy vehicles and buses.
