07.01.2022 DRIVER LICENCE DISQUALIFICATION MATTER This week I appeared in a traffic law matter at the Downing Centre in central Sydney. My client had been disqualified from driving until the year 2057 due to a number of offences and being declared a habitual traffic offender.... As new legislation has recently been introduced by the NSW government, a pathway now exists to make an application to the Local Court to get the disqualification removed. In consideration of my client completing a traffic offenders program, reconnecting with the community, increasing work opportunities and other factors, the court granted our application. 05.01.2022 COVID-19 DOMESTIC VIOLENCE Initial media reports and society sentiments suggested that domestic violence would rain and significantly increase, as a consequence of the COVID-19 restrictions. We are not seeing it to be frank and our views to explain why are, as follows: -... - pubs and hotels are shut curbing alcohol fuelled arguments and violence; - Police Stations are shut and Police resources are diverted to other matters; - economic pressures are such that people cannot afford to separate and so are pulling together more than ever, as people did in times before divorce became common place. For those apprehended violence orders that are proceeding and that we have appeared on the process has proven frustrating in some cases with long adjourned periods due to court closures; but in other cases matters have been more swiftly dealt with by Police resulting in apprehended violence orders being withdrawn. 01.01.2022 CORONAVIRUS AND BAIL APPLICATIONS. Coronavirus is impacting on the prospects for bail. Accused persons who have been refused bail previously are now being granted bail due to the issue of delay. Here is a case extract where Coronavirus has directly impacted on bail:... Re Broes [2020] VSC 128 (19 March 2020): [46]Given the extraordinary circumstances in which we now find ourselves, I have come to the conclusion that an already significant delay will be likely exacerbated by the consequences of COVID-19, and I am therefore satisfied that exceptional circumstances have been established. [39] there can be no question that once the virus is discovered in any of the Victorian prisons, there will have to be a significant lockdown for a number of reasons. The transmission between prisoners will be significant and likely to occur at a much greater rate than the transmission that is occurring in the community at present. That will result in a large number of prisoners becoming quite seriously ill, depending on their age and underlying conditions. I appreciate these are matters of speculation to a degree, but the situation is sufficiently urgent to required them to be taken into account.
