24.01.2022 A Power of Attorney for financial matters is a very useful (and often convenient) tool. Particularly if you are often travelling and need someone at home base to sign off on transaction documents for you, or if you simply like to delegate! However appointing an attorney for financial matters (in Queensland) requires a little more thought than you may realise..... https://croninmiller.com.au//presumptions-of-undue-influe/

15.01.2022 Weve been sharing Covid-19 related updates all week. We believe in keeping you informed and knowledge is power. But it is also overwhelming, and a little on the bleak side. It is nice to share some news that leaves us with a warm feeling. Not that this good news story isnt Covid-19 related. The Flanagan-Power family from Tasmania were split and separated by oceans. Sure it started innocently, a family holiday where Dad, Rob, and 9 year old son Ruari took a family trip to Ro...bs origins in Ireland. But Covid-19 hit, and it hit hard and fast. Bringing them home was priority number 1. But just because you have flights booked and paid for doesnt mean youre assured of getting to your destination. Not when there is a worldwide pandemic in play. On Monday morning the chaos was real. Emirates, co-sharing their flights with Qantas, confirmed they were grounding their fleet from Wednesday. Cancellations by Emirates meant Rob ad Ruari didnt make the first two scheduled flights. But with back-up flights with Etihad, they were set to go and a reunion was still in sight. 12 hours later and the flights cancelled. All ports in UAE closed, with little notice, and with the last flight out of Dubai fully booked, Rebecca, waiting at home in Hobart with their two daughters, resigned herself to having her husband and son having no way home in the near future. She knew it could be months. They would be loved and cared for in Ireland, but separated from her and Ruaris sisters in what is a new and frightening world in the wake of Covid-19. And then a lifeline. Qantas booked Rob and son Ruari on a Qatar fight, the only airline left in operation, requiring four transits through foreign and domestic airports, a path home, but not a certain one. The next update was more promising: a new set of flights from Qantas. Hope was re-enlivened. The A380 London to Sydney came through for them but it was a new route for Qantas. A brand new flight customised just to bring Australians home. Darwin airport struggled in response to the required power supply. Delays, but they were on Australian soil. Connecting flights from Darwin, to Sydney to Melbourne and finally, Hobart. Qantas got them home to their family. Two little girls and an anxious wife and mother who then, in true Covid-19 style, went immediately into lock down. Together. And as an example of the gift that will keep giving, Rebecca, with support of Rob at home, is able to give back as an emergency registered nurse, once she comes out of quarantine. Thank you Qantas #qantas #thankyou

11.01.2022 Has September’s forecasted economic cliff turned into a potential 2021 avalanche? The protections for directors from personal liability for insolvent trading were due to lift on 25 September 2020 this Friday but two weeks ago the federal government announced the extension of the protections to 31 December 2020. Directors of companies need to be aware that these protections are not a total safeguard! You may still be liable for breaches of your duties under the Corporation...s Act and, if your company is trading insolvently, notwithstanding the extension of this protection, there are other avenues that a liquidator (should one ultimately be appointed) can explore to pursue recoveries for the benefit of the general body of creditors. Make sure you are receiving the right advice, at the right time. Contact one of our specialist insolvency lawyers for more information. Read the full article on our website - https://buff.ly/33MrErf

11.01.2022 Actually you can! With the assistance of an advisor or loved one who can assist in presenting evidence to the Court of the true testamentary intentions, a "statutory will" may be created. If your loved one has lost capacity and their current will no longer reflects their wishes, the Court has the power to make, alter or revoke a will. For the court to step in with this power the person without testamentary capacity must be alive and the person who is asking the court for help... needs to show that the proposed will is, or most likely will be, what the testator would have wanted had they still had testamentary capacity. There may be any number of reasons why distribution of the estate under the current will would not be what the testator wanted. Contact our estate litigation team today if you have concerns for a loved one's testamentary capacity and whether their will needs to be updated. #australia #brisbane #queensland #goldcoast #law #lawyer #legal #lawyers #lawfirm #attorney #estatemyth #mythbusting

07.01.2022 We are forever saying that there are new developments and updates happening almost daily, so it may come as no surprise that JobKeeper 2.0 has already undergone a bit of a makeover! Just 2 weeks from the release of JobKeeper 2.0, the package has been revisited again with the consequence that eligibility will be based on single quarters, rather than both the June and September quarters and start dates for eligible employees has been revised. What this means is that business ar...e required to show actual decline in turnover for the September quarter alone (and not both June and September). There is an additional $15 billion associated with this revisit to JobKeeper 2.0 bringing the reported cost of the total package to $101 billion. Note there are no changes to the original JobKeeper which has an end date of 27 September 2020 and these changes only apply to the extended programme announced in July.
