21.01.2022 ATTENTION QBCC LICENSEES: most builders and tradies would know that when you apply for a QBCC licence, or if you have a QBCC licence already, you need to comply with the QBCCs financial reporting requirements. But do you know when you need to report financial information to the QBCC? QBCC licensees need to report financial information to the QBCC:... - when you apply for a QBCC licence; - when the businesss maximum revenue needs adjusting; - when your net tangible asset position decreases (the triggers for reporting a decrease in net tangible asset position depends on your licence category); - when the QBCC does a compliance audit into your business; - when the QBCC does what it calls an an approved audit program; - when your professional indemnity insurance expires (provided its a condition of your QBCC licence that you hold professional indemnity insurance); - if the business is operated by a company, when theres a change in ownership or officeholders; - if the business is operated as a partnership, when a partnership is restructured; - when theres a change or withdrawal of covenantors; or - whenever the QBCC asks for it. Navigating the QBCCs financial reporting requirements can be time-consuming, complicated and confusing. And theyve recently changed, with the next wave of new laws starting on 1 April 2019. If you are a QBCC licensee then you need to be ready for the changes to the QBCCs financial reporting requirements. Dont stick your head in the sand. Make sure you have a really good accountant on board who understands the QBCCs financial reporting requirements. The QBCC is running a series of information sessions during February to help QBCC licensees understand the new requirements. Theres even special information sessions for accountants. For more information about these information sessions, visit the QBCCs website at buff.ly/2GcQpT9

19.01.2022 If youre thinking about giving property to family members the first thing we want to say is, thats very thoughtful and generous of you. But there are some things we recommend you think about before the property is transferred to your partner, child or family member. One thing to think about is your family members relationships. This may seem like a strange thing to think about. After all, what does your family members relationship have to do with giving property awa...y? Consider this scenario. You give your property to your daughter and she gets married or enters into a defacto relationship. If the relationship breaks down, what happens to the property you gave her? Your daughters former partner may be entitled to a share in the property. Are you comfortable with that risk? Every situation is different. Take time to think about it and get appropriate advice. Dont rush it. Weve written a blog article on the things to think about before gifting property to family members which you can read here: http://www.crouch-lyndon.com.au//3-things-to-consider-whe/

09.01.2022 When you hear the word lawyer, we forgive you for thinking about expensive suits, expensive offices and expensive fees. But people with legal problems should seek help from a lawyer as soon as possible. Especially if youve been charged with a criminal offence, injured in an accident, theres a parenting dispute, a marriage or de facto relationship has broken down or theres disagreements about debts or assets. When you need to use a lawyer, did you know you can negoti...ate how much you are willing to pay for the legal work they do? Make sure you understand what legal work your lawyer has agreed to complete for you. Ask heaps of questions if you are not sure about anything. Theres no shame in asking questions. And if your lawyer makes you feel uncomfortable or silly for asking questions, then dont use them. Lawyers have an obligation to keep their clients updated on the estimated legal costs. Depending on the value of the legal work to be done, lawyers are required by law to disclose certain information to their clients about legal costs in writing. If youre in Queensland, the Queensland Government has published some very useful information about legal costs agreements.
