11.01.2022 Why should I sign a loan agreement when giving money to my parents? Here is a common scenario: I had to put my dad in a nursing home earlier this year. I paid the bond which was a considerable amount of money. ... He recently passed away and the home will not return the bond to me until probate issues. The home says it will pay the bond only to the executor of my dad's estate. The executor says that the bond will be distributed under my dad's will equally between his 3 children as I have no evidence I lent the money to my dad. The legal problem: The bond may be considered a gift from you to your dad unless you have signed a loan agreement. If there is no evidence in writing that the bond was a loan the bond money will form part of your dad's estate. How this problem could have been avoided: Simply by signing a loan agreement with your dad. The bond would have been paid back to you by your dad's executor first and only then the remainder of his estate distributed equally between his 3 children. Call us now if you wish to know more.
