This has been justified by the NSW Government on the basis they will reduce the pressure on the states court system.

21.01.2022 In these uncertain times, one absolute certainty is our mortality, albeit hopefully later rather than sooner. It is therefore important to have your affairs in order through the preparation of a Will. A Will is a legal document which sets out who will receive your property and possessions when you die.... When you have a valid Will, you give yourself the best chance of making sure your assets go where you want them to. If you die without a valid Will (referred to as dying intestate), the rules of determine how your assets are to be distributed. Usually, this means all your assets will pass to your spouse. If you do not have a spouse, the order of relatives who are eligible to inherit is children, parents, brothers and sisters, grandparents, aunts and uncles and cousins. However, the situation becomes more complex if you have a legal spouse and a de facto spouse (i.e. you have separated and have a new unmarried partner), or if you have children from different relationships. Further, if you die without a Will and without eligible relatives, your estate will pass to the State. The intestacy rules usually only let your family members inherit from you so having a valid Will is essential if you want to leave gifts to friends or charities. To complicate things even further, in our modern society, there is an ever-increasing rate of blended families, a family consisting of a couple, children they may have had together and children from previous relationships. The complexities involved in drafting a Will that appropriately addresses the competing interests in such cases cannot be overstated. Our experience in this area and the capacity to draw upon the advice of a specialist Barrister means you can feel comfortable that your wishes can be fulfilled, and the risk of contest being significantly reduced.

17.01.2022 MENTAL HEALTH We place a huge level of importance on our clients' mental health. Did you know that since June 2014, Shane has been a Part-Time Member of the Mental Health Review Tribunal of NSW. The Mental Health Review Tribunal is a quasi-judicial body constituted under section 140 of the Mental Health Act 2007. Its functions operate for people receiving either involuntary or voluntary treatment under the Mental Health Act and forensic and correctional patients under the Mental Health (Forensic Provisions) Act 1990.
