13.01.2022 Although the transfer of responsibility for damage or loss is clearly defined in Incoterms 2020, insurance questions often arise when damage or loss occurs, which can be too late! It is important to determine where the sellers' obligations end and buyers responsibilities begin and what coverage attaches under their insurance policy(s). If there is any doubt in the buyer's mind about whether or not they will have proper recourse against the seller for loss or damage during t...heir responsibility, the buyer may wish to review these doubts with their insurer and arrange additional coverage. The sales contract should clearly state the type of insurance to be provided along with the Incoterms 2020 under which the goods are sold. It can be important for the actual place of insured destination to be shown clearly in the sales contract and insurance documents, especially with Incoterms 2020 where destination delivery or similar arrangements are included. 01.01.2022 Incoterms are primarily used for determining how the sale of equipment for delivery across international boundaries will be handled and who will pay for what in the transaction. Incoterms cover details about Delivery (when the sellers deliver to the buyer), Risk (passing from buyer to seller) and Cost (liability for which costs). They will not address the consequences of a breach of contract or exemptions of liability. Incoterms relate to the terms between the exporter and... importer. Incoterms 2020 rules do not deal with the transfer of ownership of the goods, breach of contract, or product liability; all these issues need to be considered in the contract of sale. Incoterms 2020 rules cannot override any mandatory laws.
