An employer and/or person conducting a business or undertaking (PCBU) must consult with workers when they are affected by any situation involving their health and safety. This includes the workers ability to express their views and contribute to any decision being made. For instance, the replacement of workplace equipment, even for the purpose of risk control, must be discussed with workers before a change is made. ... 07.01.2022 Did you know? - Your duty to consult workers, Part 2. The person conducting a business or undertaking (PCBU) must: - Consult with the workers on how consultation process will occur. This includes an explanation of the worker's requirements. ... - Ensure the nature of consultation is consistent with requirements under section 48 of the WHS Act. This includes the sharing of relevant information and allowing workers a reasonable opportunity to contribute. - Ensure consultation occurs as required under section 49 of the WHS Act. If a process for consultation has been agreed with workers, the consultation must be performed in accordance with those terms. This process must also be monitored and reviewed at a regular interval to ensure that it remains the most effective form of consultation.
