Under Part VIIIB of the Family Law Act 1975 (Cth), the Court can order that certain payments from superannuation can be allocated to a party to a marriage or a de facto relationship that has broken down. This can occur after a Courts determination of the matter or by agreement between the parties. This is sometimes referred to as a payment split, where some superannuation from one party is allocated to the other party to the marriage or de facto relationship.... Did you also know that there are a range of superannuation interests that a Court may have jurisdiction to make a payment split for?
