Under Part VIIIB of the Family Law Act 1975 (Cth), the Court can order that certain payments from superannuation can be allocated to a party to a marriage or a de facto relationship that has broken down. This can occur after a Courts determination of the matter or by agreement between the parties. This is sometimes referred to as a payment split, where some superannuation from one party is allocated to the other party to the marriage or de facto relationship.... Did you also know that there are a range of superannuation interests that a Court may have jurisdiction to make a payment split for? For example, some pension streams are classified as superannuation interests and can be subject to a court order for a payment split. 16.01.2022 This morning, Shannon Daykin participated as a panelist in Queensland Law Society’s expert panel discussion on Domestic Violence: A multi-perspective approach. Chaired by Emily O’Hagan, Shannon joined Magistrate Colin Strofield, Rebecca Fogerty and Terry Stedman in the discussion. Together the panelists covered criminal law, domestic violence legislation, child protection and family law as they addressed two scenarios. Shannon found the different perspectives everyone brought to the table to be fascinating. Keep an eye out for the recording.
