23.01.2022 MEET OUR TEAM Emma completed a double degree of Law and Commerce, majoring in Accounting and a Graduate Diploma of Legal Practice at Griffith University in 2011. Emma was then admitted as a Solicitor of the Supreme Court of Queensland in January 2012. Emma commenced her career as a law clerk in a general practice firm in Brisbane in 2009 on a volunteer basis whilst studying. During this time Emma was exposed to matters in a variety of areas of the law including criminal la...w, commercial litigation, family law, commercial law, wills and estates and property law. Since her move to Delaneys Lawyers in 2012, Emma now practices solely in the areas of commercial and property law, with a special interest in commercial and retail shop leasing. Emma also manages business sales and purchases, commercial and residential conveyancing, a variety of land transactions, as well as wills and estates matters, including the drafting of wills, applying for grants of probate and resealing grants of probate issued interstate. With the Firm being the Gold Coast’s pro bono partner with the Cancer Council, Emma deals with many clients during their most devastating times of their life and is very companionate and attentive to their needs during this very difficult time. Emma feels that this pro bono service helps her give something back to society. Emma was appointed Partner of the Firm in 2018. Emma is a member of the Queensland Law Society and the Women Lawyers Association of Queensland. 15.01.2022 Just letting everybody know with the likelihood of a full lockdown coming, Delaneys will be able to continue to operate as normal. Our systems and files have been cloud based for the last few years and we are registered for electronic settlements with PEXA and currently use PEXA regularly. We are also registered for stamp duty payments and titles office registrations online. Many firms have been reluctant to transition to up to date cloud based technology so make sure before you send any work, particularly conveyancing off to another firm, ensure they can actually access their entire files and conduct a settlement electronically when working from home. All of our phones and direct numbers will still also directly access the relevant staff member.

10.01.2022 We are currently receiving numerous calls from both tenants and landlords for Commercial Properties concerned about the forced shut down of certain industries and the requirement to continue to pay rent. If your business has been forcibly shut down as a result of a sudden order from the Government with no foreseeable end date then there is a possible argument that the Commercial Lease is 'Frustrated' and at an end. Both landlords and tenants need to bare this in mind when neg...otiating substantial reductions in rent during these uncertain times. We are encountering a number of very stubborn landlords, who if they do not generally negotiate a reduction with their tenant may end up no tenant and no recourse against the tenant. There is no hard and fast rule and each tenancy needs to be considered on its own facts with the first point of call always being the lease documents themselves.
