16.01.2022 The Insurance Council of Australia and the Australian Financial Complaints Authority have agreed to run a test case on the operation of an exclusion clause that may be preventing many businesses from accessing cover for COVID-19 losses. Several Australian business interruption policies exclude cover for losses arising from quarantinable diseases under the Quarantine Act 1908 (Cth) (as amended). However, the Quarantine Act 1908 (Cth) was actually repealed in 2015 with the ena...ctment of the Biosecurity Act 2015 (Cth) and so, it is questionable whether insurers could reasonably continue to rely upon such an exclusion to refuse cover. Instead of referring to ‘quarantinable diseases’, the Biosecurity Act 2015 (Cth) refers to ‘listed human disease’. COVID-19 is a listed human disease under the Biosecurity Act 2015 (Qld). The terms ‘quarantinable disease’ and ‘listed human disease’ have different meanings, with the latter being more prescriptive. The test case is aimed at helping to provide clarity for insurers and insureds, as to the legal interpretation of this exclusion. See link in comments for our previous blog post about COVID19 losses and insurance.

13.01.2022 UNINSURED ?? Talk to an expert. We act for clients who (for whatever reason) find themselves or their business faced with a claim and either: had no insurance at the time of the event ... had insurance but their insurer has declined cover Emotions of panic, fear and guilt can be overwhelming for clients when they first come to us. We totally understand and we offer solutions - not judgement. Engaging an experienced insurance lawyer at the earliest possible stage can mean: you discover you should not be liable for all or part of the loss you’re advised that an insurer should in fact cover you for the event you understand the process you find that another party should be liable We act for people and businesses (not insurers). This specialised focus of our business means that we’re well placed to guide clients through the insurance law process. We have a special interest in helping clients in: ROAD ACCIDENTS PUBLIC LIABILITY CLAIMS WORKERS COMPENSATION We always strive to put our clients in a better position (both legally and financially) than when they first come to us. Check out what our clients have to say > https://g.co/kgs/7PQveY For an appointment - call (07) 3067 3025 or visit www.dennings.com.au.

11.01.2022 This week I received this warm feedback from a longstanding client. It stopped me in my tracks and reminded me of a few things about being a lawyer: - the legal profession is one of service and I should always remember that; - lawyers have the potential to make a positive impact in people’s lives, to do excellent work and to improve the perception of lawyers within our community; and - our so called ‘soft skills’ like kindness add value to a business and can reward us with clients for life.
