21.01.2022 Devonport Agricultural & Pastoral Society Inc 31 March 2020 DEVONPORT GREYHOUND MEETING @ DEVONPORT SHOWGROUND 31 MARCH 2020... TasRacing and the Office of Racing Integrity chose to not hold the Devonport Greyhound meet at the Devonport Showgrounds today. The Devonport Agricultural and Pastoral Society (DAPS) has in the past expressed serious concerns in respect of TasRacing’s continued use of the site during the COVID-19 crisis and has made clear that it expects Tasmanian law be obeyed at the Showgrounds. DAPS and the Office of Racing Integrity were contacted by Tasmanian Police this morning by email, advising that TasRacing has not been deemed an essential service and had no current exemption in place. Further, Tasmanian Police advised that TasRacing had informed Police that an application for exemption is in the system, but there has been no resolution at this stage. DAPS was surprised and disappointed to learn this from Tasmanian Police as it appears this activity at the site and the attempt to hold today’s event (with ~100 people) is a breach of the law, and entirely contrary to community expectations. Based on the correspondence from Tasmania Police, the Office of Racing Integrity’s representatives at the Devonport Showgrounds this morning confirmed the event could not, and would not proceed, on the basis that Tasracing did not hold and could not produce the required exemptions. DAPS also notes the unfortunately misleading public statements made by Tasracing today regarding the closure of the event. It was not DAPS that caused the race event to be cancelled, it was Tasracing’s failure to obtain the necessary exemption to allow it to comply with the Premier and the State Government's directions. DAPS has been advised by Tasmania Police that race activity at the site cannot proceed. DAPS considers this to be a matter between Tasracing, Tasmania Police and the Tasmanian Government. 15.01.2022 Due to current Covid-19 gathering restrictions, we are unable to hold our AGM normally scheduled for this time of year. Once we are able to do so, DAPS will advise members of the rescheduled date. In the mean time, all annual reports and other relevant information will be emailed or posted to members.

01.01.2022 It’s time for Tasracing to stop bullying DAPS. The Devonport Agricultural and Pastoral Society is tired of Tasracing’s lies. Here’s the truth about everything: ...Claim 1: Tasracing falsely claims they have a lease. Fact 1: There has never been a lease. They have never had a lease. TasRacing are being clever with their language. The only agreement (that has now expired) is titled an Agreement for Lease, but this does not make it a lease. They have never had a lease, only a licence. While similar words, legally they mean very different things. A licence" is a much less permanent arrangement than a lease". DAPS challenges Tasracing to publicly release the document which they claim is the lease. They won’t be able to, because no such document exists. Claim 2: Tasracing falsely claim they have a 25 year lease dating from 2015. Fact 2: No. TasRacing’s last agreement expired in 2015. The only document that exists is an expired licence agreement from 1990-2015. As recently as the end of 2018, TasRacing and north-west racing officials were publicly stating: We met with TasRacing last week to discuss how they are going with a new lease TasRacing and the Show Society are very positive that a new short term lease for two to five years will be signed before Christmas they will enter into further negotiations for a longer term If you would like to read one the articles, click the link in the comments below. Claim 3: Tasracing claims it exercised a clause in their last ‘lease’ agreement to obtain a valid and enforceable lease until 2040. Fact 3: This isn’t true. Tasracing did try to extend their last license, which ran out five years ago. Due to a lack of good faith during discussions, meant DAPS didn’t agree to this, which DAPS is legally allowed to do. So, no deal. Claim 4: Tasracing says it tried to refer the dispute to mediation, but DAPS didn’t want to mediate. Fact 4: That’s not true. DAPS has always wanted to resolve this dispute without the need for expensive lawyers. DAPS just wouldn’t agree to mediate the way Tasracing wanted to mediate. Tasracing wanted to mediate by forcing DAPS to agree to give Tasracing a 25 year lease FIRST, and THEN negotiate the rent. Think about that. Would you agree to rent your home to someone for 25 years BEFORE you knew what the rent was going to be? Instead, (at a time when DAPS had the financial resources to sustain it) DAPS proposed a straight mediation overseen by the President of the Law Society. Interestingly, Tasracing ran a mile when DAPS proposed that at the time but has now commenced legal action when DAPS does not have the financial resources to defend itself. Claim 5: Tasracing claims they are "acting in good faith", as they try to drag DAPS to court. Fact 5: Tasracing have used taxpayer money to what feels like bulling and intimidation Its a bit like a school yard bully saying they are here to help the younger kids in the playground. In other words, it’s absolute rubbish. When a tax-payer funded body like Tasracing tries to take a not-for-profit community organisation like DAPS to court, it feels like corporate bullying. The test should be simple. Who is in the right, and who is in the wrong? Instead, Tasracing wants to make the test about who has the biggest wallet. That’s never going to be fair because Tasracing is taxpayer-funded and gets to use the taxpayer’s wallet. This bullying has gone on for too long. DAPS and the people of Devonport have had enough. Claim 6: Tasracing has paid commercial rent for the site Fact 6: Tasracing has short changed DAPS for over 30 years DAPS original agreement did not allow Tasracing’s payments to DAPS to keep pace with the fair value for the use of the site. Today TasRacing pays the monthly equivalent of a small office while they use 6.5ha of Devonport city centre land a fraction of its fair value. DAPS have tried in good faith to update the rental amount, however Tasracing has avoided doing so. Another example of Tasracing’s games. Claim 7: Tasracing have invested in the site and the region Fact 7: Tasracing have let racing at Devonport Showground fall into disrepair and not given racing in the North-West the facilities and infrastructure it deserves and needs. It is sad to see the disrepair of the Tasracing equipment at the Devonport Showground. TasRacing have not made a major investment in the site for years. The key infrastructure is almost 30 years old - well past its used by date. Many of the buildings are in disrepair. As a result the site is a source of homelessness, drunkenness and drug use. Not what you want in the centre of Tasmania’s third largest city.
