21.01.2022 When you take a short break to Surfers Paradise in the middle of winter

19.01.2022 I often get asked if you can use recordings of conversations with your ex-partner in Court. A recent Federal Circuit Court case has decided that recordings between a Husband and Wife while handing over their children was allowed as evidence, even though the Husband was not aware he was being recorded. The mother had made allegations of domestic violence and she had made the recordings for her own safety. But the Court also found that recordings of conversations between the Husband and the children were not allowed because they were not in the public interest and they were not made for the protection of the mother's lawful interests. This is a positive outcome considering the current levels of domestic violence related deaths in Australia.
