18.01.2022 Contrary to popular belief, the state does not receive your assets if you die without a Will. Chapter 4 of the Succession Act 2006 (NSW) sets out the order in which your eligible relatives will inherit your estate if you die without a will. It is always advisable to talk to your solicitor about your assets and to put a succession plan into place to ensure your family are looked after adequately and assets are passed in accordance with your wishes.

17.01.2022 We know its cold, but if youre planning to collect wood from travelling stock reserves (TSRs) you could be in serious trouble. It is illegal and fines of up t...o $5,500 apply. There are no exemptions, and anyone caught removing timber or disturbing either live or dead vegetation on the TSR network is breaking the law. In times of drought, stock routes are especially important for the movement of herds - and are a valuable refuge for endangered fauna. Decaying timber and leaf litter are also important in the process of nutrient recycling back into the soil. While permits are available to collect firewood from selected state forests, Local Land Services do not issue permits for wood collection. Action may be taken against anyone found removing firewood or carrying out other illegal activities such as dumping rubbish, riding dirt bikes or four-wheel driving. People can report any illegal activity to Local Land Services on 1300 795 299, or to their local police station on 131 444. Making a note of registration numbers, descriptions, locations and dates can provide valuable assistance in the prosecution of offenders. For more information contact your nearest Local Land Services office on 1300 759 299. 11.01.2022 #COVID19 Frequently asked questions Q: Can I take a learner driver for a lesson? A: Under the Public Health Orders, a person cannot leave their place of reside...nce without a reasonable excuse. A reasonable excuse includes travelling for the purposes of work where you cannot work from home, so driving instructors can leave their house for their work to teach people how to drive. We consider that it would be a reasonable excuse for a person to leave their house to receive driving lessons (either from a driving instructor or a member of their family), given that this is a learning activity that cannot be done from home and is akin to the listed reasonable excuse of travelling to attend an educational institution where you cannot learn from home. Learner drivers could also continue to drive with a supervising family member for any of the listed reasonable excuses for leaving the house for example, driving to the supermarket

10.01.2022 This Christmas, it wont be a question of which rural road in NSW police will be on, but when they will be on it. Operation Safe Arrival, the Christmas/New Year... road safety-enforcement operation, starts at 12.01am on Friday 21 December 2018 and concludes at 11.59pm on Tuesday 1 January 2019. Double demerits will be in force throughout the period for speeding, seatbelt, mobile phone and motorcycle helmet offences. As Friday is a designated school day, an additional demerit point on top of double demerits will also apply to all relevant school zone offences committed on that day. During the 2017-2018 Operation Safe Arrival period, 31 lives were lost in 26 fatal crashes on NSW roads. Of the 31 lives lost, 19 were drivers, seven were passengers, two were motorcyclists and three were pedestrians. About 42 per cent of fatal crashes during this time occurred between 11am and 5pm. During operation Safe Arrival 2017-2018, police conducted 700,200 random breath tests and charged 1585 people with drink driving. Traffic and Highway Patrol Commands Assistant Commissioner, Michael Corboy, said back roads in rural areas will be a main target for police random breath testing. We will be travelling the same roads that you will this Christmas. Your trip is our trip. It will be those feeder roads that lead to our major arterial roads such as the Pacific, Newell and Princes highways, Assistant Commissioner Corboy said. Generally over Christmas we have looked at major thoroughfares getting in and out of Sydney, where a lot of crashes occur. This year it wont be a question of which road will we be on, it will be a matter of when will we be on that stretch of road? Minister for Roads, Maritime and Freight Mrs Melinda Pavey said while November had the lowest road toll recorded on record (since 1936) its important not to become complacent. If youre on the roads this holiday season, I encourage everyone to be their best self behind the wheel, whether youre driving in the city or travelling in the country, so you can return home to loved ones, Mrs Pavey said Motorists are also being reminded that from 17 September 2018, an extra demerit point was added to the penalty for illegally using a mobile phone while driving. This will add an additional two demerit points in double demerit periods resulting in a total of 10 demerit points for this offence.

10.01.2022 Take care on our roads this upcoming Australia Day Long Weekend

09.01.2022 GAZUMPING - Don’t you just love that word ? But what does it mean ? Gazumping occurs when an agent or seller accepts an offer you make to buy a property at an agreed price but the property is sold to someone else. This usually happens when the vendor sells the property for a higher amount. The agent is legally obliged to pass on to the vendor any further offers received for the property up until the exchange of contracts.... If you are considering purchasing a property, we can help guide you through the process to ensure you know your legal rights.

02.01.2022 YOUR DOMESTIC ANIMALS Did you know that in NSW all domestic animals are classified as property? So, if your dog attacks and injures another domestic animal, this is said to be a property dispute because one persons property has been damaged. The NSW Companion Animals Act 1998 establishes that dog owners have a legal responsibility for their dogs actions and can be held personally liable for injury or damage caused by their dog. Generally, negligence by the dog owner needs to be proven before compensation can be sought by the other party.
