03.01.2022 Thank you to everyone who attended last Wednesday night for the Northern Suburbs and Beaches Family Law Practice Group’s last Practice Group meeting for the year. It was another successful event and it was great to have such support from our colleagues. 03.01.2022 SPOUSAL MAINTENANCE LIABILITY DOES IT EVER END? How long does a spouse’s liability to support their former spouse last? It could be decades if not properly dealt with at the time of settlement, according to a recent case in the Federal Circuit Court. In Blevins & Blevins, a recent 2019 case, the wife was aged 69 years and the husband was 71 years old. The parties had separated in 1996 and were divorced in 1998. Final property and spouse maintenance orders were made on 8 Jul...y 1999. The orders provided for the husband to pay the wife spouse maintenance of $750 per month for a period of 10 years. The orders also permitted the wife to seek further spousal maintenance when the order expired, which is an unusual order. When the first spouse maintenance order expired, the wife did indeed apply for further spouse maintenance. On 12 May 2009, an order was made requiring the husband to pay the wife a lump sum of $275,000 for spouse maintenance. This time, the orders did not specifically provide for the wife to apply for any further spouse maintenance. Understandably, the husband was of the view that the ongoing financial relationship between him and his former wife ended with the lump sum payment, especially since by that time they had been separated for 13 years! On 2014 the wife turned 65 years and was in receipt of the age pension. When the pension asset test changed in January 2017 she lost the age pension, and again sought spousal maintenance from the husband. The case was heard in mid-2019, some 23 years after separation, and 10 years after the lump sum spouse maintenance order. Judge Baker held that there was no current spouse maintenance order in force, and the wife had correctly applied for a fresh order. The husband asserted that the wife was out of time to apply for a maintenance order, and she needed leave (or permission) from the court to apply, relying on section 44(3) of the Family Law Act. That section contains a 12 - month time limit after divorce for certain financial applications. But Judge Baker rejected the husband’s arguments and quoted from a Family Court appeal decision in 2016 called Atkins & Hunt, which held that new spouse maintenance orders can be made in circumstances where the initial order is properly made within time. That case also talks about the difference between a property order which has an end date and a spouse maintenance order which can be changed. Judge Baker held that the 12-month limitation period does not apply where there is a maintenance order previously made and properly made within time. It often means they can stay at the same school with their friends and in the home that they know. The challenge lies in the level of co-operation required between the parents.
