25.01.2022 On 20 August 2020, the Victorian Premiers Office announced an extension on the ban of evictions, rental increases and rent relief for residential and commercial tenancies until 31 December 2020. We expect further official announcements to be made, currently it will affect: Landlords:... - Further land tax reductions (doubled to 50% from earlier 25%) - Additional Grant funding - The Victorian Small Business Commissioner given greater powers to make an order for rent relief if a landlord refuses to respond to rent relief requests For Tenants: - Extension on the ban on evictions until 31 December 2020; - Commercial landlords required to provide rent relief in proportion with the fall in turnover being experienced by eligible tenants going forward until 31 December 2020 - Additional Grant funding We have been assisting clients with their tenancy negotiations and continue to do so. Calling one as the other may have adverse consequences on certain transactions. ... A deed (often expressed as "signed sealed and delivered") must be in writing and give the strongest indication of an intention to be bound by the terms of the document. In comparison, an agreement can be oral and requires consideration (an exchange of value) to flow from one to another in exchange for the promise to fufil the obligations under such agreement. A key difference is that a deed does not need consideration for it to be legally enforceable.

The Federal and State Government imposed shutdown on non-essential trading has created significant rental stress for retail tenants nationwide. On 7th April 2020, the Prime Minister announced a mandatory code that would be implemented by the States and Territories applying to tenancies where the tenant is eligible for the Job-keeper Payment Subsidy (turnover having fallen >30% of at least one month) and have tu...rnover of less than $50 million. We are following the matter closely and until the exact details are released and enacted by the respective States and Territories, the Code is said to include: For Landlords: - Cannot terminate the lease or draw on Tenant’s security bond/deposit - Required to reduce rent in proportion to the trading reduction in the tenant’s business through waivers and/or deferrals of rent payment. - If deferrals of rental payment, must be minimum deferral of 12 months. 11.01.2022 Yesterday we had the opportunity with @alectofinance to volunteer with @chinlifecandles and make some candles in support of the Chin community in Myanmar. @chinlifecandles are hand-made by the Chin people in Melbourne who have been forced to flee their home country, Myanmar. The candles are sold to provide much-needed funds for the people still living below the poverty line in Chin State (being 80% of the population). ONE Candle will provide 5kg of rice for a family. TWO C...andles will support a child to receive suitable medical treatment. THREE Candles will help a mother to gain maternal health care.
