23.01.2022 CONCILIATION CONFERENCE AT FEDERAL CIRCUIT COURT Today I represented a client at a Conciliation Conference in Melbourne. I approached the negotiations from my pragmatic point of view and worked a shuttle style mediation between the parties. The net effect was a final property settlement being reached. 22.01.2022 HOW WOULD AMAZONS JEFF BEZOS DEAL WITH HIS DIVORCE IN AUSTRALIA? Firstly in Washington, the home state of Bezos, wealth acquired within a marriage is split 50/50. This rule does not apply equally to Australian family law matters.... While a 50/50 split can often occur there are many factors which the courts consider. Also we have a no-fault system which means that an extramarital affair does not effect the separation assets. This can be highly emotional for clients and something that you should talk through with your lawyer. It the case of high net worth individuals it can be extremely complex to gain accurate valuations of family trusts, businesses, overseas investments and tax liabilities. The approach should be to negotiate a settlement with the other party where it is possible. This reduces the time in dispute and the costs of litigation. 21.01.2022 MAN STABBED BY WOMAN WIELDING HIGH HEELS When Kyle Johns, 19, headed out on February 23 to party with a friend in Brisbane's Fortitude Valley, he had no idea his night would end in the emergency room, getting staples in his scalp. As he walked down China Town Mall in the early hours of Sunday morning, he was suddenly approached by Jazzmin Fry, a complete stranger out celebrating her 21st birthday.... Fry then stabbed Johns in the head with her heel, leaving him bloodied and fearing for his life. Last week, Fry pleaded guilty to assault and a magistrate imposed a $250 fine with no conviction recorded. It's a result that has upset Johns, who feels like the punishment would have been far more severe if it was him who had attacked a woman. 21.01.2022 RECOVERY ORDERS Recovery orders can apply where one party has relocated with their children, without the consent of the other parent. It may also apply to cases where a parent has refused to return a child to the custody of the other parent under a Parenting Order A Recovery Order can be made which directs the Australian Federal Police or Officers of State and Territory Police forced to locate the child and deliver them back to you.... The Order can be filed by a number of relevant parties and this can be discussed with your lawyer. Urgent applications can also be filed on your behalf if the situation warrants. 18.01.2022 APPEARANCE AT MELBOURNE FEDERAL CIRCUIT COURT Today I represented a client in the Melbourne Federal Circuit Court. The matter involved two parties who had recently separated and the subsequent spend time arrangements for their child. In many circumstances, the court will give both parties the opportunity to submit proposed parenting orders to the court in order to progress the matter without the determination of a judge. However, in this case, as both parties were not able t...o reach any agreement on the day, the court ordered that the spend time arrangements should be according to the informal arrangement that was previously in place. Further, the court ordered that a family report be prepared and that as both parties were of substantial financial means, they both contribute equally to the cost rather than the court being landed with the cost. 14.01.2022 FAMILY COURTS TO STAY OPEN DESPITE COVID-19 CRISIS The Federal Circuit Court and Family Court Chief Justice Will Alstergren said the Family Courts will stay open despite the current crisis overwhelming the country. Justice Alstergren said the courts will hold as many hearings as possible using video conferencing or telephone, but where in-person appearances needed to occur, they would.... In times of crisis, there is greater propensity for family violence, he said. We have to make sure we provide access to justice, we have to ensure people are properly cared for in those times. Since the spread of the Coronavirus, a number of changes have occurred in the Family Courts. I represented the Applicant in this private AVO matter involving intimidation, harassment and death threats in a sporting environment from one hockey mother to another.... 10.01.2022 DEPARTURE ORDER SOUGHT FOR CHILD SUPPORT ASSESSMENT This week I appeared in a matter in the Family Court regarding a Departure Order sought by a parent from a CSA assessment that was presently in place. Under section 116 of the Child Support (Assessment) Act 1989, a party can apply to a court for an order to depart from a present child support assessment.... Under section 117 of the Act, the court must consider, among many other things, that it is just and equitable and otherwise proper to do so. In the present circumstances, the Departure Order was sought as there was an expectation that the children would be educated at a private school and on the basis of the income and earning capacity of the other party, both key elements of section 117 of the Act. During the day there were extensive negotiations which were concluded by way of Consent Orders being signed therefore circumventing the need for a judicial determination. Both parties were reasonably happy with the outcome as it concludes the matter that had been on foot for an extensive period of time. Of note, section 129 of the Act also allows for a party to apply to the court to vary the Orders should there be a change in circumstances. 09.01.2022 CORONAVIRUS COURTS The courts are racing to put in place technology for hearings to be done remotely. In terms of criminal and traffic law what this means is that persons who are not present in a court room will not be at risk of going to jail.... Bail applications will be able to be run on account of delays being encountered and persons are more likely to get bail granted. 06.01.2022 CHILD RELOCATION MATTER IN PARRAMATTA Today I represented a client in child relocation matter at the Parramatta Federal Circuit Court. The matter involved the parties presently living in Sydney with the mother wishing to relocate to Queensland with the two children.... The major considerations that the court focussed on today were the family environments present in Sydney and Queensland, the employment of all parties concerned and the motivations of the mother to relocate interstate. Typically in relocation matters, the court will take a conservative approach and as was evidenced today, the court was not of the mind to make Interim Orders allowing the mother to relocate interstate with the children. 02.01.2022 EX FIANCÉE FABRICATES CLAIMS ABOUT PARTNERS ABUSE A web of lies and deceit spun by the woman who had promised to love him resulted in Mr Jones facing 20 years behind bars for crimes he did not commit. Daniel Jones met Sarah Jane Parkinson in 2011, and the pair quickly fell in love. Within just a few months they began planning a wedding and building their own home. ... However for months, Sarah Jane Parkinson had been feeding a story of heartbreaking abuse and violence to her police colleagues at Queanbeyan police station, where she worked as a clerical assistant. She told her police friends she was being brutally assaulted and abused by her fiance, Mr Jones. The false allegations resulted in 32 offences being laid against Mr Jones by police and a prison sentence in a maximum security prison. 02.01.2022 FAMILY COURT ATTIRE Waiting at Court as I write this on Facebook to comment on the fact that I have seen a man into the court room this morning wearing a Bad Man t-shirt. I understand that people come to court to make a point, but perhaps this is not the best way to do it through your choice of t-shirt.... If this was in the case that I was representing the other party I would make a specific point and reference to the fathers t-shirt and call his antics out; likewise, if it was my client that turned up looking like that I would tell him to go and buy another shirt.
