25.01.2022 Each year Australian police access over 300,000 pieces of metadata. So when considering how and what you do online, be well aware that police have sweeping powers and they arent afraid to use them. The big question for us as a community continues to be whether we support even more access, or value our privacy more as individual citizens? https://theconversation.com/unlawful-metadata-access-is-eas
25.01.2022 The longer the coronavirus drags, more and more businesses are hanging on by the skin of their teeth. So what happens in September, when JobKeeper, the moratoriums on loan repayments to banks and evictions by landlords, are all scheduled to finish? Lots of talks of zombie companies being held together by their sheer will to survive and the governments duct tape of various payments. 24.01.2022 Oldie but a goodie... Here is an old blog we did on proceeds of crime in Australia. One of the most notable cases in Australia would be Schapelle Corby's case back in 2006, when the Australian Federal Police tracked large payments from Australia to an Indonesian bank account for publishing a book and an article.... So are offenders allowed to keep the proceeds of crime? https://www.greenandassociates.com.au/keeping-your-nose-cl/ As always, feel free to contact us regarding any related issues. 23.01.2022 Weve all heard stories about people being written out of, or otherwise treated poorly in a will (and many times this happens very close to the death of a loved one). At Green & Associates we have extensive experience advising on the often complex and always sensitive disputes around Wills and Estates. Lets be honest, no situation where someone is disputing a will is going to be easy, but there are some very important reasons this happens. We understand how sensitive such ...matters are for all involved, and we offer sympathy, understanding and highly effective advocacy in the absence of judgment. We can assist with: Simple family provision claims and contested wills; The removal of rogue trustees and recovery from them; Non-estate assets and foreign assets; and Issues arising during lifetime, such as contested Powers of Attorney and Enduring Guardianships. When we take on a matter, we strive to minimise costs and obtain the most commercially beneficial outcome while maximising a clients claim or entitlement. https://www.greenandassociates.com.au/ See more
22.01.2022 $8.7 Billion dollars - thats how much the Australian Government loses to Tax Fraud and Tax Evasion.
22.01.2022 With restrictions easing now and more people in clubs, pubs and bars, we also predict increased police searching for potential drug offenders. Caught red-handed with drugs? 20.01.2022 Wanna see the full extend of social media influence? Sit down and watch "The Social Dilemma" on Netflix! The new Netflix documentary has everyone talking about data collection, large social media companies do and the granular amount of detail they gather about you. ... From what you like, what you watch, to how long you watch it for Social media companies are tracking every interaction, to predict (and influence) your behaviour. All of this is designed to drive ad revenue and increase profits. And as they need to keep you scrolling, they'll do anything and everything to keep you addicted to their platforms. To consume more media, to get more ads in front of you, and make more money from you. If you're concerned about your data or your "social media addiction" it is well worth having a watch.
20.01.2022 $8.7 billion dollars. Thats the amount each year the Australian Government loses to Tax Fraud and Tax Evasion. Anything from simple mistakes made when filling out tax returns to elaborate tax avoidance schemes. With the ATO stepping up their auditing efforts though, more people will be caught! If you have been given a notice from the ATO of any kind, or charged with tax evasion or fraud its extremely important you speak to us as soon as possible. ... Why? Because the penalties can be significant. From good behaviour bonds to financial penalties and even long-term imprisonment. 02 8080-7585 https://www.greenandassociates.com.au/
20.01.2022 Fretting over your tax return? This financial year, the ATO are planning to crack down on tax crime and ramp up enforcement now that most of the country is on top of the pandemic. You can also expect that the ATO focuses on whether companies and individuals have been compliant this year with everything related to coronavirus schemes such as JobKeeper and early release of super. ... 19.01.2022 Police Powers - not content with having their powers consistently increased with next to no pushback from the community, some countries (looking at you NZ) have been using the present crisis situation to radically boost police powers of entry. In a classic "never let a good crisis go to waste" approach, the sweeping increases in powers are being hailed on the one hand as necessary during a crisis, but shot down as a power grab without reason. Wherever you sit on this is likely to rest on how worried you are about the situation getting worst and that is more than fair enough. The issue is that once taken, these powers are rarely given up by government. So where is an appropriate line to draw? https://www.nzherald.co.nz/nz/news/article.cfm

17.01.2022 Have you been stopped and searched by cops for no apparent reason? It might have something to do with the fact that the NSW Police have been imposing "stop and search" KPIs on their officers! Yes, quotas, KPI - call it whatever you want. Just under a quarter of a million personal searches (this includes strip searches) were to be performed in 2019/2020.... The cops need to have "reasonable suspicion" that someone has something in their possession that is dangerous, or is related to an offence, to conduct a search in the first place. So, what do you do when you think you fall short of your KPI? Stop and search a few teenagers to tick a box? Targets are dangerous because they risk facilitating police abusing their powers. Just another case which again highlights the need for greater scrutiny of policing practices! https://www.abc.net.au//nsw-police-strip-search-q/11960682 02 8080-7585 https://www.greenandassociates.com.au/

17.01.2022 Carol Baskin... killed her husband, whacked him! Youd have to be living under a rock to have missed Tiger King on Netflix (if you havent though, binge it tonight). Among many of the truly mind-bending situations the show throws up is an implied accusation that one of its main protagonists, Carol Baskin, was involved in the disappearance of her husband (by feeding him to a tiger!). 17.01.2022 Wondered which areas got hit hardest by the Police with Covid-19 related fines? Young men in poorer suburbs and towns with high aboriginal or immigrant populations were top of list. With nearly 1500 fines handed out for breaches in the last few months, this article is a strong reminder of who police target, and where they target offenders. From a Covid perspective what stands out most is that there was no relationship between where fines were handed out and Covid hotspots.... interesting point to think about when considering the reason the fines were put in place. To read more check out this recent SMH article. https://www.smh.com.au//the-suburbs-and-towns-that-copped-
17.01.2022 NSW Police handed over $1 million worth of fines in just over 5 weeks at the height of COVID-19 restrictions. $50,000 of those fines were given to children between 10-18 years old. Yes, to children as young as 10! COVID-19 offences fall under the Fines Act which, in theory, enables 5th graders to be issued with an infringement notice. There have been multiple calls from legal centres to have these controversial fines withdrawn and completely scrapped, with not much success.... Have the police again been given too much power, with not enough scrutiny? Have they circumvented essential legal thresholds such as reasonable suspicion and standard of proof? 17.01.2022 Have another beer, but hands off the joint?! People assume drugs are illegal because they are dangerous. But their illegality isnt related to their relative risk or harm. Did you know, that at various times around the world, coffee has been illegal and cocaine has been widely available? 16.01.2022 There have been reports that 96 young people aged 17 years or under were strip-searched by police in New South Wales over the past year. And as it turns out, many of them unlawfully. 15.01.2022 Where to for the economy in NSW? As long as the government is able to keep the spot fire breakouts of Covid under control, there is no doubt that business will step in to make up for lost time. 13.01.2022 Buying a puppy online? Sure, $300,000. What??? Thats how much money Australians lost during Coronavirus pandemic falling for puppy scams. Unscrupulous scammers taking advantage of people looking for their furry isolation companion use every trick in the book. Cute photos, adorable videos. Great price.... If it sounds too good to be true, it probably is. According to ScamWatch, Australians have so far lost more than $53 million to all reported scams this year. 11.01.2022 By increasing the timeframe for a debtor to respond to a Bankruptcy Notice before a creditor can commence bankruptcy proceedings to 6 months, has the Government simply built a massive dam of future insolvencies? While a lot of businesses may have been cheering, in the grand scheme of things 6 months isnt a long time, especially when we will be exiting into a difficult market for business anyway. 10.01.2022 NSW Labor is proposing law that would criminalise coercive control and jail perpetrators. What's coercive control? It s also known as "intimate terrorism"; coercive control is the psychological abuse manipulation and surveillance, gradual isolation from friends and family, rigid rules, humiliation and threats the patterns of behaviours perpetrators use to dominate their victims. A review by the NSW Coroners Court found 99 per cent of domestic homicides were preceded by ...some form of coercive control. The new law would prosecute for patterns of behaviour (rather than individual assaults that are often regarded as minor by the criminal justice system). Also the prosecution wouldn't need to prove that a victim had been harmed psychologically or physically. It would be enough to prove that the perpetrator intended to harm the victim, or was recklessly indifferent to the harm. There a different views on effectiveness of this proposed law, and its potential for abuse. Great read on it here - https://www.abc.net.au//coercive-control-domestic/11703442

09.01.2022 Footys back! No matter who you cheer for, theres something inherently positive about some of the normal things we look forward to being back on. From a legal perspective there have been disputes over referees, disputes over vaccinations, and disputes over TV contracts. Fascinatingly, the only dispute that ended up in a formal legal framework was between the NRL and the referees! True to form the whistleblowers were a bigger pain in the backside than the actual players. ...It got us thinking about how these disputes have been managed. Most of them through a give and take negotiation between closed doors where the parties were able to thrash out a resolution. This is exactly how normal disputes are dealt with, and where Green & Associates really excel. 08.01.2022 Do you think it’s appropriate for police to have the power to detain and arrest anyone, without a warrant, if they committed a drug-related offence 10 years ago? We sure don’t. This massive increase in police powers is directed at marginalised groups and will do nothing to decrease the prevalence of drugs in circulation. It will capture people with minor juvenile records and is a significant attack on civil liberties. ... The government’s drug supply prohibition order bill, introduced to parliament last month and supported by the Labor opposition, would introduce a two-year pilot program in four local government areas allowing police to 'search convicted drug dealers and manufacturers, as well as their homes and vehicles, at any time without a warrant'." 08.01.2022 At the peak of the nations COVID-19 control measures, police were granted sweeping powers over Australias citizens. Leaving your house without a reasonable excuse became an offenceand yet in many cases, it was left up to police to decide what a reasonable excuse was . So what happens if we do go through a second wave of coronavirus? Should the public expect (and accept) the police will be granted the same level of power they were earlier this year? 08.01.2022 Some recent criminology reports indicate an increase in property crime is on the horizon as unemployment and homelessness impact the Australian economy. Well, big surprise! Shutting down businesses and driving people out of work has been an effective means of controlling the virus, but it was inevitable that the cost being born would ultimately fall on those less able to afford it.... What most people misunderstand about crime rates is that they are closely tied to socio-economic indicators like high unemployment or homelessness. So what are we going to do about it? The government needs to proactively respond and give young people some hope that new jobs will be created, or we will enter a cycle of unemployment and crime that costs everyone. While we have a war on drugs that does nothing but increase incarceration, we are failing the public health test to prevent avoidable deaths. Governments can and must do better. https://www.miragenews.com/500-overdose-deaths-five-years-/
