25.01.2022 Putting the Dual Sport into the DSMRA

24.01.2022 Well, 2020 strikes again. Our interview coming out tomorrow is with the crew who run the Kowen Forest Ride 2020. Make sure you download it from all the podcas...t providers to get an insight into the hard work it takes to create this event and why this outcome is so devastating to the organisers. #covidstrikesagain #endurofail #2020isdone

23.01.2022 Kowen Goes Off !!

23.01.2022 Besides welcoming the newly elected National Committee and its newest members, a huge thank you is due to our outgoing President (Tim Clarke) and Secretary (Andrew Stacey) for all their hard work, insights, deliberation to make the DSMRA a better and leading association within the motorcycling community. All the best in your other endeavours Tim and Andrew. Thanks again ... Peter Wenderoth National Treasurer DSMRA See more

22.01.2022 On behalf of the DSMRA I am delighted to say that the Bathurst Branch of the DSMRA will soon be running rides again. The President, Tim Clarke, Steve Donkers, Vice President & Geoff Oates from Sydney had a semi formal meeting with Tim Chadwick Cox, Area Coordinator, Kevin Miller, Bathurst Secretary & several Bathurst members. We went over some of the documentation, our insurance cover & how to list a ride online, using the paypal sign on system. Bathurst has been a little qui...et for a few years & it's great to see a whole bunch of enthusiasm on the rise once again. After last years AGM the Committee made a commitment to offer a years free membership to past members, who had been neglected by the membership officer or lack there of. We belong to a great club, of like minded guys, Australia wide. The club has a great committee at the moment who are making the club open & transparent for everyone. There is much information about the club & it's documentation on our web site for all to see. If you are interested & wish to renew your membership for free, please contact [email protected] & we will do what we promise to do. Once again, welcome back Bathurst, we're all looking forward to seeing you on the trails once again. Yee ha :) See more

21.01.2022 It is with great regret that we are going to have to cancel the Kowen Forest Ride planned for October 2020. The committee have literally tried everything we cou...ld spent hours on the paperwork; COVID plans, meeting officials etc and were committed to go ahead. But in the end no matter what we were going to be restricted, not only to what we can do, but to ultimate numbers of 100. With requirements to monitor the residence (and possibly previous travel plans) of all participants. It was our opinion that although we could meet the restrictions and run the event it would not be the event we had planned and not the event you originally signed up for. Ultimately it was the 100 person cap currently in place in the ACT that signalled the death knell for the event. Hopefully, the restrictions keep easing and we can look towards running a cracking event next year. Although from the way government officials are talking it may be some years until the event is allowed to return to its former glory. Contact: [email protected] with any enquiries.

20.01.2022 Sharing from another post. Everyone, you need to be aware of this post, be careful & be street smart. Elephant in the room As a part of my business activities I have cause to liaise with Forest Corp NSW.... Discussions I have had with FC NSW head office are centred around access to forests via motorcycles. Major contributing factors that have lead to the closing of forests and the limiting of organised off-road events as described to me by head office are: The ability to record routes via GPS unit & mobile phone apps The ability to track/route share on mass The posting of videos on Facebook/YouTube etc that identify the area Fact: The posts on social media are used as evidence of illegal activity in forests, bearing in mind only formed gazetted roads are the only legal options, there are some remaining snig tracks which are still classed as formed roads. Forest Corp NSW are very active on Facebook, Instagram and Youtube, they use it as a tool. I know of one group who is currently facing fines and court action. Please consider the future of the sport before posting videos that identify an area, ask yourself what possibly benefit can come from it verses the downside. This needs to be taken seriously, two very popular events held in NSW forests have already been very much affected

20.01.2022 Kowen Forest this year has been postponed to the weekend of 9,10,11 October. Fingers crossed the later date will distance itself from the virus outbreak & we can all enjoy a cold Corona without mentioning this dreaded pandemic. It's a very good decision on behalf of the Kowen Committee Yee Ha

19.01.2022 Just one week to go before 3 lucky winners ride away with new KTMs! With only 1800 tickets sold - the odds are very good - if you buy a ticket it will be you receiving a call from Mitch Lees and the Kowen Committee. The bikes are ready to go - so no waiting for bikes to arrive from the Covid stricken factory in Austria! https://www.rafflelink.com.au/dsmras-win-a-ktm

19.01.2022 Riders at a Coomera bike track are outraged after finding copper wire strung between trees. They say the man trap couldve been deadly if someone was to unknowi...ngly come across it. "The wire was tightened to the point where if you hit it, it wouldve cut your throat open" - Brady Staite. Report on 7 Gold Coast News at 5:30pm. #7News

18.01.2022 Dear members & friends, many of our favorite riding areas are being affected by fire. Please observe the advice of emergency services and forestry authorities to avoid putting yourself at risk. Fire can be unpredictable and can move extremely rapidly. Even weeks after fire has passed, the risk of falling trees or branches remains. When riding, please also be extra vigilant about hot exhaust components and sparks - its very dry out there and fires are easily started. Stay safe

08.01.2022 STANDING ON FOOTPEGS Hi All, For many years many of us riders would stand on the footpegs to stretch our legs or to go over an obstruction oblivious to the fac...t of the legality or otherwise. Surprise surprise it was illegal. As a result of various representations made by the NSW Motorcycle Council and others, that rule was changed and you can stand on your pegs with your backside off the seat .or can you? I have had to defend a couple of riders who have done just that and been breached by police. You would be justified in asking why. It appears that the legislation when drafted left a clause that was designed to satisfy the Nanny State. Reg 271 of the ROAD RULES governs this Road Rules 2014 Current version for 8 September 2018 to date (accessed 29 January 2019 at 14:17) Part 16 Rule 271 271 Riding on motor bikes (1) The rider of a motor bike that is moving (other than a rider who is walking beside and pushing a motor bike), or the rider of a motor bike that is stationary but not parked, must: (a) sit astride the riders seat facing forwards, and (b) if the motor bike is movingkeep at least 1 hand on the handlebars, and (c) if the motor bike is movingkeep both feet on the footrests designed for use by the rider of the motor bike, unless the motor bike is moving at less than 10 kilometres per hour and either: (i) the rider is manoeuvring the motor bike in order to park the motor bike, or (ii) the motor bike is decelerating to come to a stop, or (iii) the motor bike is accelerating from being stopped. Maximum penalty: 20 penalty units. (1A) The rider of a motor bike that is moving may: (a) stand on the motor bikes footrests or footboard designed for the riders use if: (i) the rider has both feet on the footrests or footboard, and (ii) in the circumstances, it is safe for the rider to do so, or (b) remove a foot from the footrest or footboard designed for the riders use if: (i) the rider is sitting on the riders seat, and (ii) at least 1 foot is on a foot rest or footboard, and (iii) in the circumstances, it is safe for the rider to do so. As you will see from the above section in the circumstances, it is safe for the rider to do so. This has resulted in clients of mine being charged because the police officer has considered it unsafe. Two cases come to mind. A rider on a dirt bike who was riding and was standing on the pegs as he travelled along the road. The highway patrol vehicle was stopped at right angles to the travelling bike at a red light. The police vehicle followed the bike and pulled over and charged the rider. We defended the case and adduced evidence from the rider of the many years of experience as a rider that he had and the police in car video showed that he was riding in a controlled manner. Furthermore the highway patrol officer was shown photographs by me in cross examination of police riders using trail bikes standing on pegs and he had to concede that these bikes just similar to my clients were designed to allow standing and riding whilst maintaining control. My client was eventually acquitted by the Magistrate who made the finding that what the rider did was safe. Another case was of a similar nature of an experienced rider on a registered dirt bike riding with his father and standing on his footpegs. He did this after a long day ride and was stretching his legs. Again he was pulled over and charged by the highway patrol. On attending the police station to view the in car video I could see no action by the rider that would constitute being unsafe. I then had a meeting with the Sergeant in charge of the Highway Patrol office who agreed with me and the matter was subsequently withdrawn. So as you see from this article and some of the earlier ones whenever there is a discretion given to a police officer it can very much be determined by the subjective views of the officer such as whether he dislikes you or the fact that you ride a bike. As you can see from the legislation, similar to the rule governing standing on footpegs, is the rule relating to the removing of one foot off the footpeg by the rider whilst seated unless safe to do so. You are in trouble if your pillion does any of the earlier mentioned transgressions and there is no defence of that nature irrespective of how safe it may be. So bare in mind be careful next time you decide to stand on the pegs. The article as written is for your information and interest only. It is not intended to be comprehensive, and does not constitute and must not be relied on as legal advice. Please be aware that every case is different and the matters I am raising may not be of specific relevance to your situation but may have a general application and you must seek specific advice tailored to your circumstances. I will also gladly talk to anyone on the phone if confused or want clarification. Chris Kalpage Kalpage and Co Solicitors kalpageandcosolicitors.com.au 0418211074
