19.01.2022 Personal Guarantees are a tool used by financiers and parties seeking additional security against funds lent or goods provided, with validly executed and binding guarantees allowing the secured party to recover debt from a third party. In the current economic climate, personal guarantees are becoming increasingly common as banks rely on them to reduce their level of exposure and increase their security position. Before providing a personal guarantee, it is essential that you... first consider the legal implications of doing so. Renee Pappagallo, Partner of the DSS Law Property and Commercial team, provides an insight into why you need legal advice before providing a personal guarantee: https://dsslaw.com.au/do-i-need-legal-advice-when-providin/ If you are seeking legal advice pertaining to a personal guarantee, or are currently a guarantor under an existing agreement, please contact Renee on (07) 3210 2373 for an initial consultation today.
