19.01.2022 Contracts for Selling your Home with a Pool - Are you Compliant? The requirement to attach a swimming pool compliance certificate with your Contract for Sale has been extended to April 2015. All houses with swimming pools must be registered with the Swimming Pools Register (see http://www.swimmingpoolregister.nsw.gov.au/). When you sell your house your Contract must include a certificate of compliance or it may be rendered unenforceable. Contracts are our specialty so please contact us if we can help.



16.01.2022 Property and Leases - Monthly Tip - May 2018: When signing a Contract with the agent make sure that the buyers named on the Contract are the same as the persons who will be on the title to the property. If not then you may potentially be liable for more stamp duty.... For example, if persons A and B sign a Contract (and are not related persons for stamp duty purposes) but only A is the person to be on title then an extra 50% of the stamp duty is payable! This is because for stamp duty it is treated as though A has bought out B's share (which is not the case in reality). Don't be caught by this trap. Give our office a call to check first before signing and our principal lawyer will be more than happy to guide you through the process.

11.01.2022 THE COURT OF APPEAL SPEAKS! We were following the fortunes of Mr Goudappel in the NSW Court of Appeal last month. Mr Goudappel lost his right to claim lump-sum compensation for his work injury due to a change made, literally, overnight by the State Government to the laws. He made a claim for compensation prior to the changes but not a specific lump sum claim until after the new laws came in. The Commission ruled that his entitlements were lost and Mr Goudappel appealed to t...he NSW Court of Appeal. The Justices of the Court of Appeal on Monday unanimously decided that the changes to the law on 19 June 2012 do NOT apply to claims for compensation lodged before the changes. Bar the NSW Government bringing an appeal to the High Court of Australia, it is a win for the workers of NSW and for justice! 11.01.2022 Property and Leases - Monthly Tip - June 2018: Buying a Property? Before you sign make sure that you know (or brush up on) your cooling off rights: 1. After both seller and buyer signs and dates Contracts, the buyer ONLY has the right to cancel the Contract before the 5th business day after the Contract is made. Weekends and public holidays are not counted (e.g. if the Contract was signed on the Sat/Sun the cooling off period expires on the following Friday).... 2. If you decide to cancel during the cooling off period you will forfeit 0.25% of the Contract purchase price. 3. An extension of the cooling off period is allowed past the 5 days but only if it is agreed in writing by the seller. You cannot rely on the agent's word. It must come in writing from the sellers legal team. 4. You can choose to waive your rights to have a cooling off period but only if your solicitor provides a signed s66W certificate. 5. IMPORTANTLY - there are no cooling off periods if you have bought at public auction. This also applies if the property has passed in at an auction and you sign afterwards on the same day as the auction. 6. LASTLY - cooling off periods do not apply to buying commercial property, only residential property. If you have any questions please do not hesitate to give our friendly team a call to discuss. 09.01.2022 This is something close to home and to the local community that we serve. Australia does not have a Bill of Rights enshrined into our Constitution, unlike the US, UK and even NZ! The Constitution is extremely difficult to change. Section 18C of the Racial Discrimination Act provides only limited protection and recourse against racially offensive behaviour and now certain elements of the extreme right wing even want it removed or watered down. 08.01.2022 The NSW Court of Appeal will hear the matter of Ronald Goudappel vs Adco Constructions later this month. The question to be decided by our state's highest Court is whether a worker who lodged a claim for any compensation prior to the law changes on 19 June 2012 will be denied lump-sum compensation under the new laws. This decision impacts upon many workers who have unfairly lost their entitlements because of the government's nasty changes.... Watch this space! 04.01.2022 In 2012 the NSW Government stripped down workers compensation in 2012 to almost nothing. Our "inside" sources have told us that motor vehicle accident compensation will also be getting the axe soon!
