23.01.2022 ***SA Nomination Criteria Update Analysis*** Following is my analysis of SA nomination update announced this afternoon. Current SA nomination is an interim arrangement until Commonwealth budget which is going to be announced on 6th of Oct'20. It is expected that migration program will be more clear once commonwealth presents its budget.... From now on until budget, SA has received some quota for its state nomination program. Following link is a must read for anyone interested in SA state nomination under current system. https://migration.sa.gov.au//supporting-information/state- You need to focus on minimum requirements when you read the above link. Please note that applicant must be working for minimum THREE months in SA in nominated occupation or closely related occupation. Also read the requirements set out in preferred requirements. Please note that these are preferred requirement which means you have a better chance of being invited if you meet these preferred requirements. Also note that preference may be given to those who are in critical sectors. At this stage, only EOIs can be submitted. The MIA has received reports that the States and Territories have received a very small allocation of places for BIIP and SC 491/190 nominations, until the Federal Budget is handed down on 6 October 2020. Very strict conditions have been imposed on the occupations the State and Territory Governments can approve for the SC 491/190.... We are preparing to re-open with new policies and nomination criteria to support Victoria’s economic recovery and the public health response. You may wish to prepare your Expression of Interest (EOI) so that you’re ready once more information becomes available. EOIs are lodged through the Department of Home Affairs SkillSelect system. The Government of South Australia has been advised of a limited number of interim allocation places for the State’s General Skilled and Business Migration Program for 2020/21, which will be prioritised to support South Australia’s economic and public health recovery. ... The full nomination allocations for 2020/21 will be determined later in the year as part of the 2020/21 Budget process. Given the limited number of available nominations, South Australia’s program requirements and application processes for the General Skilled and Business Programs are currently being finalised, with a view to applications being open in late August 2020. Based on direction from the Department of Home Affairs, applications will be prioritised according to: High quality applications within the Business Innovation and Investment Program, with those who have already lodged an ‘Intention to Apply’ given priority consideration. Applicants critical to supporting South Australia’s response to the COVID19 pandemic, including individuals providing critical or specialist medical services, critical skills required to maintain the supply of essential goods and services; or delivering services in sectors critical to Australia’s economic recovery. The release notes five visa changes: Grants of student visas in all locations lodged outside Australia will recommence, so visa holders will be ready to travel when borders reopen... Free VACs for international students who lodge further student visa applications, if they were unable to complete their studies within their original visa validity due to COVID-19 Current student visa holders studying online outside Australia due to COVID-19 will be have that study counted towards the Australian study requirement for a post-study work visa Graduates who held a student visa will be eligible to apply for a post-study work visa outside Australia, if they are unable to return due to COVID-19 Additional time will be given for applicants to provide English language results where COVID-19 has disrupted access to these services As these announcements will require legislative changes, the MIA has no further detail on until these are released and will update members at that time. Skilled migration... The state’s allocation of interim 491 and 190 visa nominations are intended to support and prioritise South Australia’s economic recovery and public health response. Prospective applicants will be able to lodge an Expression of Interest (EOI) through the Department of Home Affairs SkillSelect system. An invitation to submit an online application for state-nomination will be sent to prospective applicants with EOIs that meet Commonwealth and South Australian priorities. The Government of South Australia will publish state nomination requirements on 27 August 2020. From 31 August, South Australia will commence reviewing EOIs and sending invitations to submit an online application. Business migration The state’s allocation of interim 188 and 132 visa nominations are intended to support the outcomes of its Business Innovation & Investment Program: High quality business owners and entrepreneurs have created genuine and sustainable business opportunities in South Australia that benefits the State’s economy, local businesses and the workforce. The Government of South Australia will publish state nomination requirements on 27 August 2020. 03.01.2022 *** an important read *** English Test at the time of applying 485 visa. You will see after reading below why I always insisted on having required English score at the time of lodging subclass 485 application. It was a good option only where clients had proof that they could not take English exam due to Covid-19. ----- Earlier today several MIA members received emails from the Temporary Graduate Visa Section reversing previous advice that had been supplied on English languag...e test requirements. As members are aware, evidence of appropriate English language ability is a Time of Application (ToA) requirement for Sc 485 applications. Previously, the Department had advised that applications could be lodged with evidence that an English language test had been booked or that it was not possible to undertake a test, due to COVID 19 restrictions. Today, the section advised that it was reverting to the ToA requirements. Many Sc 485 applications will have been lodged in the intervening period between the first and today's communication. The MIA has been in contact with the responsible Director and received the following assurances: the Department is attempting to find a Policy workaround for English being required at ToA and until the Regulations are amended. no applications will be processed until the English language results are attached, effectively meaning English will be assessed at Time of Decision (ToD). this later assessment may not allow for multiple tests to occur For those Sc 485s that were auto-granted without evidence of English testing at ToA, the Department will not revisit those applications. The Department's primary concern at this time is that applicants do not become unlawful. Where members need to lodge Sc 485 applications over the weekend, because the client's current visa is expiring, they should lodge those applications. Source : Migration Institute of Australia

02.01.2022 SA has announced same status for their 190/491 state nomination program. See below update received from them : South Australia is yet to receive our full allocation of nomination places, and is therefore not in a position to open a full Skilled Migration program at this stage. Our interim process will continue until further notice with applicants who meet state-nomination requirements encouraged to lodge an Expression of Interest (EOI) through the Department of Home Affairs ...SkillSelect system. If we are satisfied with your EOI, you will be invited to submit an online application for state nomination. We ask that you review the current state nomination requirements and if you are identified as an applicant who meets the Commonwealth and State Government critical skills, we will send you an invitation to submit an application for state nomination. Applicants living and working in regional South Australia will continue to be prioritised for nomination.
