21.01.2022 Good news for pet owners living in a strata building. After a four and a half year battle on 12 October 2020, the NSW Court of Appeal handed down the decision of Cooper v The Owners Strata Plan No. 58068 [2020] NSWCA 250 (Cooper). In a unanimous decision, the NSW Court of Appeal has found that the by-law banning pets in her strata building is invalid because it is oppressive. It is oppressive because it prohibits an ordinary incident of the ownership of real property,... namely keeping a pet animal, and provides no material benefit to other occupiers. The effect of this decision is that the Court of Appeal has now set a state wide precedent that ‘no pets’ by-laws will likely be deemed oppressive and have no force or effect.

06.01.2022 Today we are celebrating our 4th year in Business. When Covid started we weren’t sure what the property market would do, but luckily we have been more busy with new clients and settlements than in any previous years. What started out with just myself (Ebony) in a home office wanting a more balanced lifestyle with my family is now now an office in East Maitland with 2 staff members Nikki and Bianca - who I would not have made it through the year without them, turning through a...n incredible amount of settlements this year. I may cry with exhaustion at the end of today but we made it, just. As always thank you to my clients who have trusted EMC to handle their property sale/purchase and to my business associates for their support. 05.01.2022 Great News for First Home Buyers who want to take advantage of the First Home Loan Deposit Scheme with the Government announcing The ‘New Home Guarantee’ (NHG). A revised set of property price caps will apply specifically for eligible properties under the NHG, for example if you are buying in East Maitland the price cap was $450K and is now $600K. Usually first home buyers with less than a 20% deposit need to pay lenders mortgage insurance.
