20.01.2022 Judgment Just In: The Court of Appeal has dismissed an appeal in relation to a dispute concerning payment of some $6.4 million to a builder under a progress pay...ment claim made under the Building and Construction Industry Security of Payment Act 1999 (NSW). The principals sought to argue that the payment claim was invalid. The Court held the progress claim (i) properly arose under the contract, (ii) had an available reference date, (iii) and any defects in service with a compliant supporting statement did not invalidate the claim.
