The MIA has contacted the Department on this issue and we have been informed that the applications that have been returned a...s invalid either do not meet the required criteria, or are missing the required evidence to satisfy the decision maker. If your client held a student visa on or after 1 February 2020 and they couldn’t complete their course during the original visa validity due to COVID-19, in order to have a NIL VAC you will need to lodge a completed Form 1545 as well as evidence which supports that the students course was impacted by COVID-19. As per the Department's email the completed form alone will not be enough, and evidence is required to support the application. This will be relevant for students who: deferred their study as they were unable to enter Australia due to travel restrictions were forced to reduce to a part-time study load were unable to complete their work-based training and/or placements The NIL VAC is not intended for students who are applying for a further student visa due to ordinary reasons i.e. including failing a course or unit of study, deferring for personal reasons or voluntarily reducing their study load.
