20.01.2022 IMPORTANT CASE FOR PARTNER VISA REFUSALS Durante (Migration) [2020] AATA 262 (4 February 2020) The Tribunal remits the application for Partner (Temporary) (Class UK) visa, with the direction that the applicant meets the cl.820.211 (2) and cl.820.221 of Schedule 2 to the Regulations for a Subclass... 820 (Partner) (Temporary) visa. The AAT examined the relationship between the applicant and his sponsor and considered whether they met the grant criteria of the visa. At the hearing, the AAT was satisfied that the applicant and sponsor provided candid and spontaneous responses about their relationship along with suitable evidence. In addition, AAT found that they maintain a continuous relationship and lived together since June 2015. The couple also satisfied that their relationship existed for at least 12 months before the date of visa application. Based on the evidence provided, the AAT found that the applicant and sponsor first met in person and commenced living together in June 2015, before applying for a temporary partner visa on January 2016. This meant that they were not in a de facto relationship for 12 months before the visa application lodgment. But, the couple had registered their relationship on 20 January 2016. Therefore, the additional criterion was satisfied even though the parties had been in a de facto relationship for less than 12 months at the time they applied for the visa. 12.01.2022 1713412 (Migration) [2019] AATA 5275 (22 November 2019) The Tribunal remits the applications for Employer Nomination (Permanent) visas for reconsideration, with the direction that the applicant meets the criteria for Subclass 186 - Employer Nomination Scheme visas satisfying Public Interest Criterion 4020 for the purposes of cl.cl.186.213(1) of Schedule 2 to the Regulations. In this case, the Department had evidence that the second applicant was caught travelling to Norway on... a fake British passport, had subsequently pleaded guilty to charges and served 45 days in jail. However, on the visa applications, the primary applicant denied that any applicant had ever been convicted of an offence in any country, and acknowledged the applications could be rejected if the information was false. The AAT was satisfied the applicant did not meet PIC 4020(1). Also, the AAT then had to consider whether there were compassionate or compelling circumstances associated with the applicant. The circumstances the AAT needed to consider involved an adult male Australian citizen who had commenced a ‘relationship’ with the applicants’ then 14-year-old daughter, leading to the birth of two children with Australian citizenship. The primary applicant provides her daughter with all the costs for the children. After considering the evidence, and notwithstanding the Tribunal is concerned with the integrity of the migration process in Australia, and thus satisfied that there exist compassionate or compelling circumstances that affect the interests of an Australian citizen (the two Australia citizen grandchildren), that justify the waiving of the condition. The Tribunal is therefore satisfied the requirements should be waived.
