25.01.2022 SHOULD E-SIGNATURES BE PERMANENT? // To facilitate business transactions in the time of social distancing, digital signatures on deeds and other documents were made temporarily legal under various Commonwealth and State laws. Digital signatures via cloud based platforms such as @adobesign are convenient and in many ways more trustworthy than old pen on paper. Use of these platforms is up exponentially as business life adapts to the new normal. A Senate Inquiry has recommended the Corporations Act be amended to expressly allow for e-signatures. 17.01.2022 RIGHT TO BE FORGOTTEN // Yesterday, the European Court of Justice held in Google's favour that the EU's famous 'Right to be Forgotten' does need to be applied globally. This means that when Google receives a request from an EU citizen to erase their digital data, Google is not legally obligated to erase this data outside the EU. To put the scale of this "problem" for Google into perspective, since 2014, Google has received more than 845,000 requests to remove a total of 3.3m... web addresses, with ~45% links ultimately getting delisted. Google has the support of human rights organisations and privacy campaigners, who deem the decision a "victory for global freedom of expression". What is the 'Right to be Forgotten'? A right under the General Data Protection Regulations (GDPR) that empowers EU citizens to request an organisation to erase information about them online. Well known examples of removed information include: A report in the Daily Mail about an airline accused of racism by a Muslim job applicant; a Guardian article about a solicitor facing a fraud trial standing for a seat on the Law Society's ruling body; URLs appearing on Google Search about a person's election as leader of a political movement from when he was a minor. 13.01.2022 $ Yesterday, ACCC Consumer Rights announced it is suing Google under the Australian Consumer Law (ACL) for misleading/making false representations to consumers about the personal location data Google collects, keeps and uses. We will be following this for you, but meanwhile here are answers to burning questions you may have: ? ACCC alleges Google misled consumers on how to switch off Google's location data collection set...tings, and didn't inform consumers that the data could be used for unrelated purposes. ? Personal location data is very valuable for target advertising services. ? Personal location data is extremely sensitive, making it important for digital platforms to take care in informing and providing options to consumers regarding its use. Risks involved include criminal data breaches. ? The maximum penalty under the ACL is 10% of annual turnover or AUD$10 million. Google reportedly made A$4.3 billion in global advertising revenue in 2018, and 10% of this is $430 million. Do you turn off Google location tracking, or is this something you forget about?
