20.01.2022 AND ANOTHER ONE - EXCESSIVE USE OF FORCE BY POLICE Last week we posted about how a Victorian cop was charged with assault for kicking a handcuffed, half-naked woman whilst she lay in a cell ( here in case you missed it: https://buff.ly/2BVGOgw). "WA Police are again under fire from the States corruption watchdog over the unprofessional and inhumane treatment of an injured woman detained in Fremantle, with 11 officers now facing disciplinary action and a twelfth facing the sack over the January 2017 incident."

18.01.2022 SURROGACY: CHANGE IS COMING...OR NOT?! By Nelson Chibwe Did you know that the current laws in WA ban single men and gay couples from using a surrogate? ... There are a number of legal issues surrounding surrogacy (a form of assisted reproductive treatment (ART) in which a woman carries a child within her uterus on behalf of another person or couple) with one major example of this being the baby gammy case of 2014 (in case you missed it, here is a quick opinion piece https://buff.ly/2UcOH8G). On the other hand, you have people like Mr De Castro, a single man who wants to use his and his late wifes embryos to create a baby using a surrogate. In his own words, Mr De Castro says "As a husband who has lost his wife, I only want to be given the opportunity to see my wife through the eyes of our child." The issue is currently before the WA Parliament and shall soon be voted on. The vote itself will not be easy with some MPs arguing that its not the Governments place to legislate in this area and others like Health Minister Roger Cook stating that "These are simple changes, humane, compassionate, and we really should be getting on with them." We shall soon find out the fate of the Human Reproductive Technology and Surrogacy Legislation Amendment Bill 2018. What are your thoughts?

14.01.2022 PREVENTION CAMPAIGN FOR DIVORCE, ANYONE? By Nelson Chibwe George Blair-West gave a TEDx talk about 3 ways to build a happy marriage and avoid divorce. Yes, we practice Family Law!, Yes, we deal with Divorces! and Yes, we love our job of helping people navigate what would be one of the most trying times of their lives! However, we would be just as happy to see healthy and thriving marriages!... As George Blair-West puts it, "So in a modern society, we know that prevention is better than cure. We vaccinate against polio, diphtheria, tetanus, whooping cough, measles. We have awareness campaigns for melanoma, stroke, diabetes -- all important campaigns. But none of those conditions come close to affecting 45 percent of us. Forty-five percent: thats our current divorce rate. Why no prevention campaign for divorce?" So what are these 3 ways to build a marriage and avoid divorce? Well Georges three life hacks for preventing Divorce are: 1) Getting married when you are OLDER. ; 2) Power SHARING with your partner, especially when it comes to decision making; and 3) Having each others back. Is your partner RELIABLE? Or can your partner rely on you?. In this talk, George gives brief explanations of those three points and how those three gel together to sustain a marriage. He summarises his talk by saying that: "I believe that the most important decision that you can make is who you choose as a life partner, who you choose as the other parent of your children. And of course, romance has to be there. Romance is a grand and beautiful and quirky thing. But we need to add to a romantic, loving heart an informed, thoughtful mind, as we make the most important decision of our life." What are your thoughts?

12.01.2022 WALKING AWAY? WHAT TO DO IF I WANT TO MOVE TO A NEW LOCATION WITH YOUR CHILD FOLLOWING A SEPARATION By Genevieve Teo After separation, you may wish to move to a new location with your child. Some common reasons for relocation include the pursuit of greater family support, work opportunities, or a new relationship. ... Whatever the reason behind the relocation, moving is a big change to a childs living arrangements and current routines. Additionally, the further the relocation distance, the more difficult it can be to facilitate and maintain a close relationship with the parent and other important relatives who remain in the childs original location. If you relocate with your child, without obtaining the other parents consent, the other parent may apply to the Family Court of Western Australia, seeking orders for you to return with your child. The Court may make orders that you return with your child and remain in that location whilst the Court considers the matter. Do note that it is a serious offence if you take or send your child overseas, if there are parenting orders in place, or if an application or appeal about parenting orders are currently on foot. If you wish to relocate with your child, you should speak to the other parent first. You may do this informally, or arrange to attend Family Dispute Resolution to discuss and explore alternative arrangements that would promote your childs relationships with the other parent, grandparents and other relatives after relocating. You may be able to reach an agreement that your child spends extended time with the other parent during school holidays, or other specific times during the year. In the event that discussions with the other parent do not result in an agreement, you can apply to the Court for a relocation order. You will need to convince the Court that relocating will be in the best interests of the child. In considering the best interests of the child the Court will look at factors such as: 1. The distance and permanency of the proposed relocation; 2. The reasons for the parent wanting to move (such as employment prospects, living costs, support of family members, new partner), and whether these are genuine, optional or essential for the parent proposing to move; 3. Possible arrangements that would promote the children spending regular time with the other parent; and 4. Practical considerations, including financial considerations. If you are thinking of relocating with your child or children, you will need to obtain legal advice specific to your situation. 11.01.2022 CONSEQUENCES OF NOT DISCLOSING DOCUMENTS IN FAMILY LAW The duty of disclosure requires the parties to a family law dispute to provide each other with all information relevant to the issues in the case. If you fail to disclose documents, fail to file an undertaking, or file a false undertaking, the Court can among other things: refuse to allow you to use that information or document as evidence in your case, stay or dismiss all or part of your case, order costs against you, or fine you or imprison you if you are found guilty of contempt of court for not disclosing the document or for breaching your undertaking. Imprisonment is extreme, but not unlikely as shown by His Honour Judge Salvatore Vasta.

02.01.2022 BRIGHT LIGHTS: MAN WHO POINTED LASER AT POLICE CHOPPER TO STAND TRIAL An Adelaide man has been charged with one count of committing an act likely to cause harm - the act being the pointing of the laser at the helicopter and thereby putting the helicopters crew at risk of harm (prejudicing the safe operation of an aircraft).
