15.01.2022 A Tall Order for Australia to Fill Skill Shortages: New TSS Visa (482) Eligibility Requirements From the 19th March 2018 onwards, it is no longer possible to apply for the 457 work visa; the 457 has been effectively replaced with the 482 Temporary Skills Shortage (TSS) visa. The TSS visa has a short-term stream and a medium-term stream. The medium term stream can lead to permanent residency whilst the short-term stream cannot. ... To apply for either stream, you must: Have an approved sponsor who has nominated you for an eligible occupation. Meet all skills and qualification requirements for the nominated position. Score at least 5 overall and at least 4.5 in every category on IELTS Meet the requirements specific to each stream (see below) SHORT-TERM STREAM SPECIFIC REQUIREMENTS: The nominated occupation must be on the Short Term Skilled Occupation List for TSS Visas. 11.01.2022 Federal Budget 2018 - Impact on Visas and Migrants The release of the 2018 Federal Budget this week has affected many different groups of people in Australia. However, some changes may affect Australia’s migrants and prospective migrants too. 1. Changes to Welfare Access... The government is proposing a bill to increase the waiting period for newly arrived migrants to access certain welfare benefits from three years to four years from 1 July 2018. This bill has not yet become law. This will affect welfare services such as Newstart and Youth allowance, paid parental leave, carers allowance, and the family tax benefit. There will be an exemption for vulnerable groups, including refugees and those who come into sudden financial hardship, such as victims of domestic violence. 2. Changes to Work Visa Places for Doctors From January 1 2019, the Government will set a planning target of around 2,100 overseas trained doctors per annum to contribute to the continued growth in overall doctor numbers. This means the total number of overseas trained General Practitioners granted work visas each year will decrease from 2,300 places to 2,100. This is to address the current oversupply of doctors in some metro areas. The government will also use this change to specifically target regional areas with doctor shortages. 3. Access to English Programs The government will remove time limits for Adult Migrant English Program (AMEP) clients aged under 18 years. The AMEP provides up to 510 hours of free English language tuition to newly arrived migrants to help them to participate in social and economic aspects of Australian life. These free classes are available to Permanent Resident visa holders, and to certain temporary visa holders. 10.01.2022 Focus on Bogus Documents: the Importance of Accurate Visa Applications Suppose you want to deliver a letter to the government, trying to apply for a job. You trust your friend to deliver those letters and he does so. You get a reply from the government that they doubt you are an alien from outer space and would improve their workforce diversity, or that you were once a spy like James Bond and therefore could be moved to the government’s secret intelligence department if ...necessary. Your friend has altered the letter! You try to plead to the government that your friend has made alterations to your application, but the government is firmly rejecting your future applications for, shall we say, the next three years. The story is relevant to migration law because it is the same case if false or misleading documents (bogus documents) were provided in a visa application for any visa (e.g. 186, 187, Temporary Skills Shortage 482, Work Visas, and Student Visas etc.) to the Department of Home Affairs. When you hire a migration agent, or trust someone else to complete your application for you, and that person alters your documents to make them more favourable, this will lead to your onshore visa applications for the next three years being rejected. Every. Single. One. This is even if you never wanted that person to alter your documents or lie your way to a successful visa application. The Department of Home Affairs will not view it as someone else’s fault that the application contains fake documents. So long as false or misleading documents were provided by someone you trusted or hired, and it is YOU applying for the visa, YOU will be the one to suffer the 3 year period of definite onshore visa rejection. This is because of the department’s view that YOU are ultimately responsible for your own application even if you hire an agent or a friend to help you. So make sure when selecting your representative, it is someone you can trust! The Department is very good at picking up on forged and altered documentation. 08.01.2022 WORK VISA UPDATE: PROPOSED CHANGES TO OCCUPATION LISTS The Department of Jobs and Small Business have the task of reviewing the jobs that are on the migration occupation lists. They have announced proposed cuts to the Short Term Skilled Occupation List (STSOL) which is used for all temporary work visas. It has been proposed that the following occupations may be removed from the STSOL: Manufacturer Visual Arts and Crafts Professionals nec... Director (Film, Television, Radio or Stage) Film and Video Editor Program Director (Television or Radio) Stage Manager Technical Director Video Producer Middle School Teacher Textile, Clothing and Footwear Mechanic Watch and Clock Maker and Repairer Cabler (Data and Telecommunications) Telecommunications Linesworker Chemical Plant Operator Library Technician Residential Care Officer Insurance Loss Adjuster The Department of Jobs and Small Business has also proposed that the occupations of Management Accountant, Agricultural Consultant and Civil Engineering Technician may be removed from the Medium Long Term Strategic Skills List to the STSOL. 05.01.2022 Ready for Regional Work: 187 Regional Work Visa Eligibility The 187 Regional Sponsored Migration Scheme (subclass 187) work visa gives you permanent residency and lets you work in regional Australia. To be granted the work visa, you need to be under 45 years of age and have the relevant skills/qualifications for your occupation on the relevant occupation list. You will also need at least 6 in IELTS in ALL categories.... If you fulfil the above requirements, there are two streams of the 187 work visa that you can apply for. One is the Temporary Resident Transition (TRT) stream, and the other is the Direct Entry (DE) steam. To apply for the TRT stream of the work visa, you must fulfil ‘(1)’ and one of the two ‘(2)’ conditions below: (1) previously held either a Temporary Work (Skilled) visa (subclass 457) or the new Temporary Skill Shortage (TSS) visa (subclass 482), AND; (2) have worked for your employer full-time for at least 3 out of 4 previous years in the same occupation that you will be working in under the 187 visa if granted, OR; (2) IF you had a 457 visa or applied and was eventually granted a 457 visa as of the 18 April, 2017, you have worked for your employer for at least 2 out of the previous 3 years full-time before the date your employer nominates you for your 187 application. To apply for the direct entry stream of the work visa, You do not need to have ever worked in Australia, or you have only worked in Australia briefly. HOWEVER, you still need to have been employed in the occupation for at least 3 years on a full-time basis and at the level of skill required for the occupation. Note how both streams have that all-important 3 year work experience requirement, unless you held a 457 visa or applied for a 457 as of the 18th April, 2017. If so, it is 2 of the previous 3 years. Every 187 work visa that we have applied for has been granted. 04.01.2022 Genuine Position Criteria for 482 TSS Work Visas I’m a muffin mixer. I spend my days working at McGuffin’s Muffins preparing dough to be baked into some of the most delicious muffins around. I know all the textures and consistencies of different types of dough, and enjoy nothing more than the sweet smell of fresh muffin in the morning. Does this sound like a genuine position to you? If it doesn’t then I’m not surprised! ... When it comes to applying for certain work visas including the new 482 TSS work visa, the Department of Home Affairs will ask: does this position sound genuine and is it a position this organization (the employer) actually needs? TSS work visa/482 work visa applicants will need to first nominate for a position of work; their occupation must be eligible for the visa they are trying to apply for as per the skilled occupation list available here (Spoiler alert: Muffin Mixer is not the list). If your occupation is on the list, you will need to satisfy the Department that what you do or will do for your employer at work includes a significant majority of tasks in the job description for that occupation at ANZSCO. You may also need to demonstrate you have the required qualifications for the job. Sometimes, the Department may feel that your job is not actually needed by the employer. This could be for instance if the company only has 2 employees but you have nominated for café manager; do you REALLY need a manager in such a situation? Even if we took our friend the muffin mixer, at first glance he might look like he doesn’t fall into any eligible occupation. He doesn’t. However! If the muffin mixer happened to also work in a high end bakery, and knew some more recipes than just muffins, he MIGHT be able to fall under the occupation of pastrycook! This would mean he is eligible for the short-term stream of the new 482 TSS work visa.
