25.01.2022 What if my new house isn’t clean at settlement? While it is of course common courtesy for a seller to leave a Property in a clean state when they vacate, the Standard Terms of the REIQ Contract don’t contain any specific requirement for a clean to be undertaken The buyer cannot hold up settlement or claim compensation from a seller if the property hasn’t been cleaned, but they may have some recourse for compensation if the property has been damaged by the se...ller or if belongings/rubbish haven’t been removed If you are buying, and a full bond clean before settlement is important to you, you may be able to negotiate a special condition to be included before you sign a contract Contact us for an example or to review a contract for you before you sign!

24.01.2022 Another Friday closer to Christmas! A reminder that all of the days between Christmas and 3 January are excluded as business days under the REIQ Contract. Any conditions or settlements that fall within this time will roll over to 4 January 2021
24.01.2022 4PM The REIQ Contract states that the parties have until 4pm on the settlement date to successfully settle Although settlements do go through on time more often than not on occasion there may be an issue that needs to be fixed (eg, with a paper settlement the lender may have drawn a cheque incorrectly or with a PEXA settlement one party may not have signed off in time) and the time may be pushed back As long as everyone is ready willing and able to settle by the time it hits 4pm they will have complied with their contractual settlement obligations
24.01.2022 Additional Foreign Acquirer DutyAFAD was introduced to ensure foreign acquirers of residential property who benefit from government services and infrastructure also contribute to their delivery, the same as local buyers Foreign purchasers must pay an additional 7% of the purchase price, ON TOP of the usual duty payable, to the Office of State Revenue You’re off the hook if you are an Australian Citizen, hold a permanent visa, or are a New Zealand citizen who holds a current Special Category Visa (swipe for details )

20.01.2022 BUILDING AND PEST If the contract is subject to satisfactory building and pest inspection reports on the property a buyer must take all reasonable steps to obtain the reports although they may elect to only obtain one of the reports They MUST use licensed inspectors for the reports and the reports must be in writing, otherwise will not be able to terminate the contract on the grounds that they are not satisfied with the building or pest inspection

16.01.2022 TRANSFER DUTY ON VACANT LAND The only concession available on the purchase of vacant land in Queensland is for first home buyers. If you are eligible, no transfer duty is payable for purchases of first home vacant land up to $250,000 in value. The concession progressively reduces as the value increases up to $400,000. There is no concession where the value of the vacant land is $400,000 or greater and transfer duty is then payable at ordinary rates. Contact us for further details !
16.01.2022 EKKA Although we don’t get to enjoy the Ekka this year, the public holiday has been moved (for select councils including Brisbane, Gold Coast and Logan) to Friday 14th August. If the Place for Settlement on your contract has a public holiday on this day, any conditions or settlements that fall due will roll over to 17 August! DID YOU KNOWsince its opening, the Ekka has only been cancelled three times... once in 1919 throughout the time of the Spanish flu pandemic, where the grounds were employed as temporary hospital wards for the sick, then in 1942, due to World War II, and lastly in 2020, due to the coronavirus pandemic.
16.01.2022 Buying a house for Christmas? With a standard 30 Day Settlement, your contract will need to be signed by ALL parties by Tuesday 24 November (this time next week!) The last business day for settlements this year is Thursday 24 December. After this, any critical dates that fall due between Christmas Day and 3 January will roll over to Monday 4 January 2021

14.01.2022 The phrase time is of the essence comes up often in legal matters, and applies to property Contracts in Queensland Essentially, time is of the essence is a contractual term that requires timely completion of a task, failing which there are consequences. If timely completion of the task does not occur, then the other party to the contract will have rights against the defaulting party. For example if a Buyer fails to satisfy a Finance or Building and Pest clause by 5pm on the due date, the Seller may elect to terminate

14.01.2022 Vacant Possession The Seller is obliged to give vacant possession of the Property at Settlement, which means the Buyer is able to physically and legally occupy the Property after settlement (except where they agree otherwise, such as buying property subject to tenancy) If you require Vacant Possession at settlement you should ensure the Tenancy section in the contract does not include any details for a tenancy, even if the fixed term expires before settlement ... 13.01.2022 JOINT TENANTS TENANTS IN COMMON If two or more people acquire a property together, it can be either as tenants in common or as joint tenants. Joint Tenants own a whole share, equally together. Tenants in Common can specify the shares in which they hold the property (can be equal or unequal). If a tenant in common dies, their interest in the property is an asset of their deceased estate. This means it can be transferred only to a beneficiary of the estate or be sold (or... otherwise dealt with) by the legal personal representative of the estate. If a joint tenant dies, their interest in the property passes to the surviving joint tenant or tenants. It's not an asset of the deceased estate. The good news is that many councils have a resource on their website to obtain FREE property flood information, with immediate reports provided We recommend you jump online and obtain this report before you sign the contract if potential for flooding is a concern for you
