16.01.2022 Examining Judgment Debtors Examination Notices can be issued by judgment creditors after they have obtained a judgment against a judgment debtor and the debt remains outstanding to them. An Examination Notice is a Court document which requires a judgment debtor to provide details about their financial circumstances including current assets, liabilities and income and any requested supporting documents to a judgment creditor within twenty eight (28) days. The information reque...sted by the judgment creditor allows them to ascertain the best way to enforce the judgment they have against the judgment debtor. Examination Notices are not filed with the Court. They are not required to be personally served on the judgment debtor and service by ordinary or express post is satisfactory. Registered post is recommended. Should the judgment debtor fail to provide sufficient details in the Examination Notice or the requested documents or ignore the Examination Notice completely, the judgment creditor may apply to the Court for an Examination Order. An Examination Order requires the judgment debtor to attend Court and be examined about their financial circumstances which they have failed to disclose in the Examination Notice issued to them. A Notice of Motion for an Examination is filed at the Court. Once issued and unlike the Examination Notice, the Examination Order must be personally served on the judgment debtor. The judgment creditor may claim filing fees and service fees in the Notice of Motion for an Examination Order. These costs can be added to the amount of the judgment debt and recovered from the judgment debtor. Additionally, the Court may also order that the judgment debtor must pay the judgment creditor the costs of the Examination Order, for attendance at the Examination Hearing and for the issue of an Arrest Warrant. The Examination Order will list the time and date of the Examination Hearing and the judgment debtor must attend the Court named in the Examination Order where the judgment against the judgment debtor was entered. However, if the judgment debtor lives or works more than thirty (30) kilometers away from the Court where the judgment was entered against them, the examination hearing will take place at the Court nearest to the judgment debtor. If the judgment debtor attempts to avoid the Examination Hearing, the Court may issue a notice stating that their failure to attend the Examination Hearing may result in their arrest. The judgment creditor may apply for a warrant to be issued for the arrest of the judgment debtor. The warrant authorises the Sheriffs Office to arrest the judgment debtor and bring them before the Registrar for examination. If the judgment debtor does not answer all the questions asked of them during the Examination Hearing, the judgment creditor can bring this to the Registrars attention. In some circumstances, the Registrar may refer the matter to a Magistrate. See more
