22.01.2022 This week, the firm discovered by reference to disclosure documents, that in preference to providing funds to the Wife and preserving the property pool for division, the Husband paid funds (five figures) to a consultant plastic surgeon as a deposit for an intended (entirely elective) procedure on himself. The firm has written to the surgeon to give notice that the funds should be considered disputed, to inform of the Wife's claim against the funds and to seek that they not be... applied as the Husband seeks, but instead preserved. We will see what response the good doctor provides. Never a dull moment and an ever-changing landscape of conduct by spouses within divorce cases.

20.01.2022 Australia's Attorney-General, Christian Porter MP, has announced a new website for separating couples, which can be found at amica.gov.au Amica is a site which is said to use artificial intelligence to help amicable couples reference information which might help them resolve issues after their separation. Having visited the website, there is indeed some basic information there which can be used as a starting point which is free of charge.... Amica relies upon honest dealings, respect for one another and a desire to minimise legal costs. It presumes parties will be on the same page about the majority of issues and that there are no special features or considerations. We will be encouraging our clients to have a look at the website as well as supplementing the information there with purposed, targeted subjective legal advice. Amica is not a one size fits all situation. Much of the information available on Amica is available, free of charge, on the Family Court of Australia and Federal Circuit Court of Australia websites, as well as the websites of many family law firms where the information is written by accredited specialists who have their names beside their work. I have read that a $3M investment was made in this program, and with due respect to our Government, I find myself feeling annoyed that this $3M was not spent in increasing Judicial appointments and Court resources to help service families who need access to the Court. The amicable parties really don't need a website devoted to them as they have found their way to resolutions for years. www.amica.gov.au



20.01.2022 Best wishes for a Happy Birthday Luke!

20.01.2022 The GCDLA Committee was saddened to hear of the sudden passing of retired Southport Magistrate, Michael Hogan, on 30th June, 2020 after suffering an unexpected ...catastrophic stroke. Michael was appointed as a Magistrate on 20th July, 2007 after an extensive career as a solicitor and barrister. Michael first worked in Mt Isa and later Brisbane and spent time working for Legal Aid Queensland and ATSILS before going to the Bar. His practice at the Bar included primarily criminal law work, but also included industrial law, personal injuries, succession and commercial law as well as determining cases as a member of the Social Securities Appeal Tribunal. Michael also volunteered extensively at the Caxton Street Legal Service and managed a half-way house for the St Vincent de Paul Society assisting recovering alcoholics. Michael brought a special knowledge to the bench given these experiences when people with addiction and affected by homelessness and similar challenges were before the Court. Michael retired from the Bench on 13th October, 2017. He had remained active in retirement, and was, at the time of his death, planning and training to walk The Camino Trail (The Camino de Santiago, known in English as the Way of St. James). The GCDLA passes along, on behalf of all members, sincere and heartfelt condolences to Michael’s family. 06.01.2022 Re: GC Bulletin Article on p12 of the Weekend Bulletin Sadly it’s never a good time to experience a separation and all that that entails. It follows that we are not fans of a message that now is a better time than ever before to trigger separation.... Separation triggers significant emotional, financial and personal upheaval for spouses, children and the wider family unit. It’s not a process to be chosen lightly. Specialist family lawyers are responding to clients’ changed needs, impacted by the Pandemic health and economic responses and impacts to the community just as we always have, with practical and informed advice. As a result, business continues as before, dealing with the issues as they present and responding to client needs. Dean Evans

05.01.2022 It's a hearty congratulations from all of us to Guy Neilson, who has today been recognised as a Rising Star in Family Law in the 2021 Doyle's Guide to the Legal Profession rankings in Family Law. Guy commenced his career with Evans Brandon straight out of UQ's law school and has been with us ever since. This is a well deserved award and something you should be very proud of Guy. We are very proud of you and all of your hard work and love having you as a member of the team.
