21.01.2022 "...the definition of a child in an estate planning context as an example of how language can significantly shape an outcome." If a "child" is not an actual legal child, or perhaps not a biological child, the outcome of an intended gift could change significantly if the language in the estate planning documents do not provide sufficient guidance. Seeking advice from an experienced estate planning lawyer is paramount.... https://smsmagazine.com.au//language-paramount-in-estate/

20.01.2022 Updates to your Estate Plan given Australia's border closures Given the current state of our boarders in Australia, both international and between states, and the fact that many people have recently moved to different jurisdictions, it may be worth reviewing your estate planning documents with regard to appointments that may have been made to individuals currently residing outside New South Wales. Although travel may not have been a major concern when the appointments were or...iginally made, perhaps current circumstances make these choices less appropriate or appealing. This is why regular annual reviews of your documents is so important. Contact Evergreen Legal to discuss your Estate Plan. #australia #property #travel #estateplan #executor #powerofattorney #enduringguardian #successionlaw

20.01.2022 Just like your Will, other estate planning documents like your Enduring Power of Attorney and SMSF Deed should be reviewed from time to time as circumstances and laws change. Here is a good example of why. https://smsmagazine.com.au//enduring-powers-of-attorney-r/

16.01.2022 What a windfall for this family. I'm unsure of the accuracy of the application of the law in this case, but for personal estate planning purposes it's certainly a great precedent. "We could have a member on their deathbed making a request to withdraw all...benefits and as long as it is submitted by express post to the trustee before death, that should be enough....... Is the ATO really going to say that is allowed, and for members over 60 to pull all their super out tax-free...." https://smsmagazine.com.au//ato-member-benefit-ruling-ra/

13.01.2022 This is why planning ahead with a wholistic approach to your wealth is so important. On 17 June 2020 Parliament passed legislation to implement the Government’s 2018-19 Budget measure of ‘improving the taxation of testamentary trusts’, and the new law tax takes effect from 1 July 2019. The new law imposes additional tests in relation to the ‘property’ that can generate concessionally taxed or excepted income. The tests include that the property that generates the income is... ‘transferred from the estate of the deceased person concerned, as a result of the Will’. In addition, the excepted income can be generated from ‘property that represents accumulations of income of capital’ from the property transferred from the estate. https://www.lexology.com/library/detail.aspx

10.01.2022 Since so much of our lives and our personal information is now posted on social media, there are a few specific things you should do regarding your online presence and that of your loved ones to thwart would-be identity thieves. Along with your will and other estate planning documents, people should keep and keep up-to-date a list of email and social media accounts and login credentials....It should be stored somewhere securely or entrusted with the estate planner or trustee. #estateplanning #socialmedia #identitytheft #makeyourwishesknown #planahead #innerwestmums #lawyermums #digitalassets http://business.time.com//grave-robbing-2-5-million-dead-/
