23.01.2022 Do I need a personal succession plan if I have young children? Personal succession planning is something all parents with young children should consider and address. By doing so you’ll ensure your loved ones have access to appropriate financial assistance, educational opportunities, and anything else they might need to ensure their quality of life continues when you’re no longer around. At a minimum, every parent with a young family should have: a current Will to distribu...te estate assets guardianship arrangements for young children and teenagers an Enduring Power of Attorney to cover situations where they’re unable to make financial decisions themselves, and appropriate estate planning arrangements to distribute specific assets that are not covered by the Will (such as superannuation benefits, life insurance proceeds, assets held in family trust/s). What are the benefits of personal succession planning when you have a young family? Personal succession planning can: provide certainty by getting the right assets in the hands of the right people, at the right time enable you to provide for your loved ones while minimising tax payable by your nominated beneficiaries provide certainty that your children are taken care of. For example, if you and your spouse were to die unexpectedly: Who would be responsible for the care and financial future of your children? Would you like your children to continue to attend the same school and receive the same level of education that you were intending to provide if you were alive? Would there be additional child care costs? Would you like to nominate a guardian/s to step into your role when you are not around? Would the intended guardian/s have sufficient funding to care for your children? Would you like your estate assets to be held on trust for your children and be distributed to them at a certain age? What are the consequences of NOT having a personal succession plan? Personal succession is something you should address now. Don’t wait until it’s too late. If you die without a valid Will, intestacy legislation will determine how your estate assets are distributed to your surviving family members. If you die without a valid superannuation or life insurance death benefit nomination, the proceeds may not be distributed according to your wishes. And, if you’re badly injured in an accident or lose mental capacity, who will manage your affairs while you’re still alive but unable to make your own decisions? 20.01.2022 When couples are contemplating marriage, the last thing on their mind is to plan for the possibility of separation in the future. Instead, couples will often believe that based on the love and respect they have for each other at that point in time, their relationship is not like other relationships and there is no possibility that they will break up in the future. Unfortunately, however, statistics show that more than one third of marriages will end in divorce. Presumably, th...e majority of those couples also felt that they too would be together ‘until death do us part’. So whilst planning for separation may not be the most romantic gesture a couple may make when they are contemplating marriage, it can be the most sensible. Divorce can often be bitter and filled with emotion. So reaching an agreement whilst you are amicable on how to divide your property should you separate makes sense, and may not only save you a long and costly legal battle, but may also save you the immense emotional strain that often accompanies a divorce.

19.01.2022 Andrew James, an experienced family law practitioner, will be joining Frigo Adamson Legal Group effective 22 July 2019, to lead the firms expansion of its legal services into Family Law. Andrew initially worked as a clerk in the Magistrates Court at Redcliffe. He later joined the Queensland Police Service, following which he was transferred to the Gold Coast. Whilst stationed on the Gold Coast, Andrew worked both in uniform and the Criminal Investigation Branch. During t...his time, he was awarded his Detective’s classification by the Qld Police Service. He resigned from the QPS after 12 years service to pursue a career in law. Andrew completed his law degree, where he was awarded First Class Honours. Andrew was first called to the Private Bar in September 2004, and went on to practice as a barrister for almost 15 years. During that time, Andrew was both a member of Atkin Chambers, Brisbane and Inns of Court Gold Coast, and practiced primarily in family law as well as commercial litigation. He has appeared in various State and Federal jurisdictions, including: The Qld Civil and Administrative Tribunal (QCAT); The Queensland, New South Wales, and Victorian Magistrates (Local) Courts; The Queensland and New South Wales District and Supreme Courts; The Queensland Court of Appeal; and The Federal and Federal Circuit Courts of Australia. 16.01.2022 In many cases parties to a marriage or a de facto relationship are able to reach an agreement in relation to the care of their children or the division of their property after they separate. This is particularly so when the separation has been amicable, and the parties remain on good terms. In these circumstances, parties often ask ‘if we have reached an agreement between ourselves, do we really need a lawyer?’ Whilst the temptation in these circumstances may be to try and avoid legal costs and rely on a ‘handshake agreement’, or even a document that the parties have prepared themselves and signed, the reality is that unless the parties properly formalise their agreement, there are significant risks on relying on this type of arrangement.

15.01.2022 When married couples separate, they will often ask: ‘When can I get divorced?’ ‘How do I apply for a divorce?’ ‘Does my partner have to agree to a divorce?’... ‘Will I have to go to court if I want to get a divorce?’ An application for a divorce, or a dissolution of marriage, will usually be made to the Federal Circuit Court of Australia. 01.01.2022 Contesting a Will? Family Provision Claims in Queensland Family provision law recognises that, although people are free to give away their property by Will after they die, or to not make a Will at all, they also have a responsibility to provide for certain people, usually family members. Did you know that under the Will of a deceased person frequently proper provision has not been made for the dependant, spouse, de facto, domestic partner or child of the deceased? This can oc...cur because the Will of a deceased person fails to make that provision or adequate provision. Alternatively, where there was no Will, and the deceased dies intestate, there is a statutory formula that sets out how a deceased person’s estate is to be distributed, and sometimes that formula might fail to make adequate provision for the maintenance and support of a person in all the circumstances. In either situation, a court has the power to make orders altering a Will, or varying the statutory formula, so that adequate provision for a person is in fact made. These types of claims are known as testator’s family maintenance claims and claimants might be a dependant, spouse, domestic partner or child of the deceased. The many factors that the court must consider in making these decisions include: the nature of the relationship between the claimant and the deceased person the size of the estate the financial resources and needs of the claimant contributions by the claimant to building up the estate At Frigo Adamson Legal Group we have a wealth of experience handling such cases.
