22.01.2022 The case of Hurst v Hurst [2018] FamCAFC 146, is a case about how indirect and direct contributions in family law property cases are treated by the court and the weight given to those contributions. 02.01.2022 FAMILY COURT RESTRUCTURE The Federal Government introduced two bills for the proposed restructure of the federal courts and the accompanying explanatory memorandum. Whatever the new court looks like, or whatever it is called, it is going to be dealing with the same problems as the current/original court. It must be funded properly, to get through the cases from start to finish in a short time. The longer it takes, the more issues arise, the more interlocutory applications are... required, the more costs increase and the longer the delays. Under resourced government court systems add to the cost for parties using the court system. As someone who has practised in this jurisdiction for 25 years, I have to say, How about asking those of us who work in this jurisdiction, what is likely to work best? Consultation by government with the profession is the first step to getting this right. The next is proper funding.
