25.01.2022 Yet another problem faced by parents in the Family Court. Here is a frustrated dad just last week...It's three years today since I last spent time with my beautiful little angel, NAME HERE. Three fucking years. It feels like ten. How is this possible?? I don't understand. How 'the system' can allow this is inconceivable to me. It doesn't just allow it, it rewards it. I have to sell my home of 15 years and give $32,000 to Legal Aid (She has to give even more) for legal costs a...nd then give 70% to the mother of my child who called me a paedophile and violent abuser, ignored court orders for contact between NAME HERE and me for YEARS with no penalty, relocated seven times in six years, each time further away from me... I just don't get it. She gets the child and all the money and I'm left destitute and homeless despite having done nothing wrong and just wanting a relationship with my biological child. And now I am eligible for jail time for breaching s121 of the Family Law Act and 'publishing' information about my case. Well big deal. Freedom's just another word for nothing left to lose... 24.01.2022 The ALRC inquiry into family law changes has received only 400 submissions on the Issues Paper. Considering the thousands of dissatisfied posters every week on FaceBook groups that is an appallingly low response.

21.01.2022 Structural change is one thing, but the intrinsic issues are far greater than creating a single one-stop shop for Family Law litigation. Those of us in the courts regularly are constantly frustrated by delays, adjournments, vacation of cases due to more urgent cases and a plethora of costly compliance requirements. Some solicitors, acting in the best interests of clients, use the court system as major battlefields to exterminate one parent from the lives of their children and inflict as much delay as possible to bring parents to their knees financially. This is a start, but much more innovative reform is required to make a real difference in this fraught area of law.

09.01.2022 The ALRC report is out and submissions are required.

07.01.2022 This is a timely reminder that those parents who do not follow court orders and continue to run an entrenched regime of alienating a parent can face harsh penalties. This is not the first and last case a parent has been given a custodial sentence. Weirs & Weirs [2012] FMCAfam 247 (7 March 2012) was another case that comes to mind. Both of these cases would be appropriate for mention in summing up in any matters that relate to parental alienation and withholding contacts when otherwise directed. The very real prospect of a custodial sentence only seems to become a reality for some when the perpetrator(s) are finally brought to the end of the court process. The rest of the time is spent in denial!

01.01.2022 The New Zealand Government Justice Minister Andrew Little said he was concerned about what he was hearing about how the courts were running, and the impact that was having on families and children. The reforms National delivered in 2014 scrapped access to free counselling sessions for couples and their children. He said "There's no support for children in these really serious situations, where the outcome for children can be serious long-term mental ill health. It's a child welfare issue." This sits well in line with what we have been promoting for many years through the Family Law Reform Coalition that Family Law is a health and social issue not simply a matter for extensive and protracted litigation in an overburdened court system.
