24.01.2022 I’ve moved out; but I can go back anytime I likeright? A common misconception among separating couples is that that person who has moved out of the family home can still come and go as they please. They cannot. ... If you have moved out, you no longer live there and aren’t allowed to go to the family home without getting the other person's permission. Even if you own the home and have personal items inside it. At no time should the person who no longer lives there let themselves into the former family home without permission. If you do, you could end up facing an allegation of domestic violence.

20.01.2022 Were you of sound mind? If not, you may not be responsible! If you were suffering from a mental illness, disability or other mental condition at the time of offending you may be considered of 'unsound mind' by the Court. If you were of unsound mind, at the time of committing the offence, the Magistrate has the power to dismiss the charges against you.... You will need to be referred for a mental health assessment. A report will be written for the Court which will say you were either of sound or unsound mind at the time of the offences being committed. Usually if the report says you were fit for trial and of sound mind at the time of committing the offence your matter will continue through the Court process. If the report says that you were of unsound mind at the time, the Magistrate will usually dismiss the charges against you. 19.01.2022 Social Isolation & Family Law Parenting Orders In these unknown times of social isolation and lock downs, compliance with Family Law Parenting Orders may become very difficult, if not impossible according to the Chief Judge of the Family Court. It is of the utmost importance that parents and carers act in the best interests of the child. This includes keeping them safe.... Parents and carers must not use the epidemic as a tool to keep the children from the other parent. They have a responsibility to adhere to Court Orders although in the event of a lock down strict adherence may not be possible. In Queensland the legislation specifically states that you can be caught drink driving on a road or elsewhere. It is the or elsewhere that is all encompassing, in that you can be caught drink driving anywhere in Queensland, that is, on a road, on a rural property or in your own driveway.... 14.01.2022 Are you in a de facto relationship? You may be without knowing it. The Family Law Act states that couples, who have been living together on a genuine domestic basis for a period of 2 years or more are to be considered de facto. Case law over the years has shown that this definition is anything but straight forward. If there is a dispute about whether a couple should be considered de facto the Court looks at things such as: whether there has been a sexual relationship, if ther...e is a common residence, the duration of the relationship, commitment, children of the coupling and how the couple's friends and family see their relationship. Interestingly you can also be married to one person and in a de facto relationship with another! 13.01.2022 If you’ve ever been involved in a car accident you know two things. One - it is a very stressful time and; two everything happens really quickly. You want to get the cars off the road, people are exchanging details, your emotions are peeked and tow truck drivers have come out of nowhere. Before you know it, your car is on the back of a tow truck and the driver is giving you a receipt which tells you where it is being taken. This is usually the tow truck driver’s holding yar...d, where they charge a daily fee as well as the towing expenses. What they don’t tell you, and most people don’t realise, is that you can have your car towed to any place you wish including your own driveway. If you have your car towed to a place of your choosing you won’t end up having to pay storage and other associated fees with the tow truck driver holding on to your car pending the insurance payout. The insurance assessor will go to wherever the car is being held to assess the damage and to report back to the insurance company on your payout amount. If the assessor recommends for the car to be repaired the insurer will organise for it to be transported to the repairer. On the other hand, if the assessor determines that the car is a write off then the insurer will organise for the car to be sold for salvage (which is a nice way of saying scrap) and will pay you the assessed amount as a cash settlement. Quite often the insurer will refuse or at least try to refuse to pay the storage and transport costs charged by the towing company, which makes settling with the insurer that much harder. If an argument about this happens, the towing company is likely to hold onto your car as collateral pending payment of their fees and charges. This is why it is always best to have your car towed to your house.

12.01.2022 It’s only a text messageright?!?!? A common belief is that domestic violence is only physical violence. This simply isn’t the case. Domestic violence comes in many different forms including controlling behaviour, threats towards one party, financial control, etc.... We see many people send abusive text messages to their former partners not believing them to be domestic violence. No matter how angry you are, or how frustrated you are with the family law process, you should never send abusive or threatening text messages to your former partner. Abusive text messages often form part of an application for a domestic violence order that cannot be defended. This is because text messages are considered to be in writing and good evidence in Court. Often the context is lost or misinterpreted because of the minimalist nature of texts, the limited grammar and shortening of regularly used terms. A Court will consider the term, FFS as swearing at your former partner! Always consider what you are sending and to whom when you are penning an abrupt text to your former partner or their family members.

10.01.2022 Gratuitous Care in Personal Injuries Claims in Queensland Gratuitous care (sometimes referred to as voluntary services) are, the care or services provided to a claimant, usually by a family member for no charge. Tasks such as domestic chores, personal care tasks as well as home and vehicle maintenance may all be claimable. A person who is making a claim for personal injury may be entitled to include a claim for the cost of gratuitous care or domestic services provided to the...m by others. While there are certain criteria that must be met for a gratuitous care claim to be successful, it is always worth knowing what may be included in your claim. The person providing the services is not the person entitled to claim for the cost of them. Only the injured person can make a claim for gratuitous care. The time spent by the person providing the gratuitous care / services may be recoverable by the injured person at the current market value (for a commercial care provider for the hours provided).

09.01.2022 If you have had a domestic violence order (DVO) taken out against you, or the police have issued you with a police protection notice (PPN), it is imperative that you seek legal advice as soon as you can. You also need to adhere to the terms and conditions of the DVO / PPN from the moment you get it. Breaching a DVO is a serious offence. If you breach the order, you may face a term of imprisonment.
