22.01.2022 COVID-19 UPDATE: JobKeeper Payment The government has introduced a $130 billion JobKeeper Payment scheme to support businesses significantly affected by the coronavirus to help keep more Australians in jobs. The JobKeeper payment is open to eligible employers to enable them to pay their eligible employees salary or wages of at least $1,500 (before tax) per fortnight.... Eligible employers will be reimbursed a fixed amount of $1,500 per fortnight for each eligible employee. Employers will need to pay eligible employees a minimum of $1,500 (before tax) per fortnight to claim the JobKeeper payment. This will be paid to the employer in arrears each month by us. The first payments to eligible employers will commence in the first week of May 2020. JobKeeper payments can be made for the period beginning 30 March 2020. If employers do not continue to pay their employees for each pay period, they will cease to qualify for the JobKeeper payment. 19.01.2022 CONSTRUCTION: Researchers recycling grapevine waste into particle board for sustainable buildings. Researchers at the University of Melbourne are taking grapevine waste and turning them into particle board, which is a staple of the construction industry. University of Melbourne's head of Chemical Engineering Amanda Ellis said grapevine cuttings obtained from pruning the plant were a major source of agriculture crop waste. The wine industry disposed of about 42 million tonnes ...of cuttings each year. "China alone produces six million tonnes and they're obviously not a heavy wine making country, so Australia would be fairly equivalent to that at around about 6 to 10 million tonnes of waste," Professor Ellis said. Grapevine waste could be used to replace the pine chip in particle board, which would help minimise import and transportation costs. Lendlease is working to rectify subsidence issues impacting $600 million worth of residential property at its Jordan Springs East master-planned estate in Western Sydney built over an old creek bed near Penrith City.... State building commissioner David Chandler said fill is occurring across a lot of current Sydney development sites and called on engineers to do their jobs. Engineers who are doing foundation designs for housing on fill should pay extra attention to the fill and make sure that their designs are appropriate for the fill that is being used, Chandler said. The owners of Sydney's Mascot Towers are claiming more than $15 million in damages from the developer of a neighbouring building they allege is responsible for major cracks appearing in the apartment complex they were forced to evacuate almost a year ago. Fair Trading is also investigating the certification work on Peak Towers, which was developed by Aland Developments and neighbours ...the 132-unit Mascot Towers in Sydney's inner-south. It is with great sadness and a heavy heart we mourn the passing of His Highness Sheikh Sabah Al-Ahmad Al-Jaber Al-Sabah, known as the Wise Man of the Region. Sheikh Sabah was sworn in as emir on January 29, 2006. He was the 15th ruler in Kuwait’s 268-year-old Al Sabah dynasty and the country’s fifth emir since Kuwait earned its independence from Britain in 1961. ... From 1963 to 2003, he served as Kuwait’s foreign minister. Kuwaitis remember Sheikh Sabah for his commitment to resolving regional issues through diplomacy. He pushed for closer ties to Iraq after the 1990 Gulf War and advocated for peaceful solutions to other regional crises. Under his leadership, Kuwait acted as a mediator in several conflicts. In 2016, Sheikh Sabah notably hosted meetings between leaders of the warring factions in the Yemen Civil War. Sheikh Sabah also positioned Kuwait as the key mediator in the Qatar diplomatic crisis. The late emir is also known for his humanitarianism, particularly amid the Syrian civil war and refugee crisis. HomeBuilder is a time-limited grant program to help the residential construction market to bounce back from the Coronavirus crisis. It will provide eligible owner-occupiers (including first home buyers) with a grant of $25,000 to build a new home or substantially renovate an existing home where the contract is signed between 4 June 2020 and 31 December 2020.... Construction must commence within three months of the contract date. 07.01.2022 PROPERTY: Changes to short-term rental accommodation in NSW. The laws for strata scheme by-laws have changed. From 10 April 2020, strata schemes may adopt by-laws prohibiting short-term rental accommodation (rentals of three months or less) for lots that are not the primary residence of the host. These new restrictions on Airbnb style short term rentals only affect owners who don't ordinarily reside in their apartments. If someone lives in a strata property as their principa...l place of residence, they will still be able to rent out their home or rooms while they live there, or temporarily go on holidays. If an owners corporation issues a by-law breach notice and the resident does not stop the identified behaviour, the owners corporation can apply to NCAT who may issue a penalty of up to $1,100 or $2,200 if the Tribunal has already fined the owner or resident within the last 12 months. A Code of Conduct for the Short-Term Rental Accommodation Industry is also being finalised. The Code will introduce obligations for hosts, guests, online booking platforms and letting agents, as well as a complaints process for anyone to complain about breaches of the Code. 07.01.2022 RESIDENTIAL: NSW Court of Appeal decision on pets in strata schemes. A recent Court of Appeal decision means that blanket pet ban by-laws for strata schemes are not valid and should be reviewed by the owners corporation. On 12 October 2020, the Court of Appeal of the Supreme Court of NSW handed down its decision in Cooper v The Owners Strata Plan Strata Plan No 58068 [2020] NSWCA 250.... The Court of Appeal ruled that a by-law imposing a blanket ban on the keeping of animals at the Horizon apartment tower in Darlinghurst was oppressive and breached strata laws: section 139(1) of the Strata Schemes Management Act 2015 (the Act). In addition, the decision also sets an important precedent for how the principle of ‘harsh, unconscionable or oppressive’ is applied to by-laws under the Act, and is binding on lower Courts and the NSW Civil and Administrative Tribunal (the Tribunal). If a lot owner or owners corporation are unsure or disagree on whether a by-law is oppressive, they can apply to the Tribunal for a decision. We recommend that owners corporations review their by-laws following the Court of Appeal’s decision. The statutory review of NSW strata schemes laws is due to start later this year. As of 1 July 2020 certifiers are regulated by the Building and Development Certifiers Act 2018 and the Building and Development Certifiers Regulation 2020. Registration... Certifiers will be registered rather than accredited with some accreditation categories merging into new classes of registration. Also, 'accredited practitioners (fire safety)' is the new term for 'competent fire safety practitioners'. Transparency for clients All contracts for certification work, and certain contracts for residential building work, must be accompanied by an information sheet about certifiers, published on the Fair Trading website. Additionally, the Home Building Act has been amended to make it an offence for a builder to influence the applicants choice of certifier. Compliance obligations The Code of Conduct is now part of the Regulation, not a separate document. Stronger enforcement powers Fair Trading has wider powers to investigate and audit certifiers and to investigate any breach of legislation and suspend a certifiers registration until a monetary penalty is paid issue public warnings about certifiers. 04.01.2022 CONSTRUCTION: Final report into the regulation of building standards, building quality and building disputes. On 30 April 2020 the NSW Public Accountability Committee tabled its final report making 22 recommendations. The government is required to respond to the recommendations within six months. The terms of reference for the inquiry were self-referred by the committee on 4 July 2019. ... The committee received 177 submissions and 25 supplementary submissions. The committee received 390 responses to an online questionnaire. The committee held six public hearings at Parliament House in Sydney, including a half day in camera hearing, and one at Newcastle City Hall in Newcastle. 04.01.2022 PROPERTY: Foreign Purchaser Surcharge Duty and Land Tax. Time is running out to amend discretionary trust deeds. Discretionary trusts Trustees of discretionary trusts will be treated as foreign persons unless the trust deed irrevocably excludes foreign persons as potential beneficiaries, even if there are no actual foreign persons who are beneficiaries.... If the terms of a discretionary trust which has acquired residential land have not been amended to irrevocably exclude foreign beneficiaries before midnight on 31 December 2020, the trustee of the discretionary trust will be liable for: * surcharge duty on transfers of dutiable property that have occurred or occur prior to 31 December 2020; and *surcharge land tax in respect of the 2017, 2018, 2019 and/or 2020 land tax years Testamentary discretionary trusts Trustees of testamentary discretionary trusts which do not prevent a foreign person from being a beneficiary of the trust will be treated as foreign persons for surcharge duty and land tax purposes if the will or codicil is executed after 31 December 2020. 04.01.2022 HOSPITALITY & LEISURE: The High Court has ruled that damages for "disappointment and distress" are available to consumers for a breach of consumer guarantees under the Australian Consumer Law for travel and recreational contracts. This means travel agents, hotels, cruise ship operators, airlines, event and wedding planners, spa-operators and other travel and recreational services may be liable if marketing material or representations are inconsistent with the promised experie...nce. Mr Moore booked a two week European river cruise with Scenic Tours leaving Amsterdam in June 2013. Moores cruise was seriously affected by high water levels on the Rhine and Main Rivers. As a result, bus travel replaced luxury boat travel for parts of that overall journey. Similar problems also affected 13 of Scenics other European cruises around that time. A class action was commenced by Moore on behalf of 1,500 passengers. Damages are assessed: at large; fair and reasonable for the disappointment and distress caused; subjective test; similar situations aren't to be followed; and will be set aside if an award is grossly disproportionate. Service providers cannot exclude, restrict or modify liability for such losses. 02.01.2022 CONSTRUCTION: Onsite inspectors have more power. A number of buildings will be selected for an Occupation Certificate Audit by NSW Government inspectors. The audit involves a review of designs and documents (including contracts) and a physical inspection of the building construction. If inspectors find a serious defect, they can enforce action to stop work, order defects to be rectified, and delay the occupation certificate being issued.... Without an occupation certificate, the building cant be occupied, and the sale of apartments cant be settled, protecting buyers and residents from poor construction. Authorised officers can: 1. enter building construction sites to do in-depth inspections without notice or permission; 2. investigate, monitor and enforce compliance, determine if the building has serious defects, take and remove samples, and require records to be produced for inspection; and 3. demolish or open part of the building work if they have grounds to believe there is a serious defect.
