03.01.2022 Thinking of buying a 2nd hand car? You need to read this... This week we're pleased to have helped identify 2 repairable write-offs that our client was looking to buy, for their daughter. Both from the same dealer, and the dealer did not advise our client of their status. Refer the 2 extracts below from the reports that we subsequently produced... In most states in Australia, except for NSW, it is legal for dealers to sell repairable write-off vehicles, but the write-off stat...us must be disclosed to the prospective buyer. For more information, it is useful to check with your state's relevant motoring authority. A repairable write-off has been assessed as uneconomical to repair. The vehicle identification number (VIN) or chassis number is recorded as a repairable write-off and the vehicle will only be registered if it: - is repaired - passes a safety inspection, and - passes a written-off vehicle inspection. And that tag of "repairable write-off" stays with that car for the rest of its days. Making it hard to secure finance, and creating problems when it comes to insurance, and resale. A repairable write-off may include a: - a motor vehicle that has been assessed as a total loss but is not a statutory write-off - a damaged motor vehicle that is not a statutory write off While there is no legal obligation for a dealer to disclose the history of a motor vehicle (unless specifically asked), it is an offence under the Australian Consumer Law for the vehicle to be misrepresented. Consequently, a dealer cannot misrepresent the vehicle in any advertising or during the negotiation process.
