16.01.2022 An interesting guidance was released by ASIC yesterday. It states that anyone recommending or suggesting someone use a SMSF to purchase real property is providing financial planning advice and requires an AFSL. Property spruikers and real estate agents are now on notice. It also allows for Accountants, tax agents and BAS agents to provide 'statements of opinion' about the SMSF and assets held with in. However, they cannot provide advice on the purchase/disposal of any ass...ets, how much to contribute into the SMSF, and whether or not someone should be able to set up and/or wind down a SMSF. It provides greater clarity as to what accountants and other professionals can and cannot do with regard to a SMSF. 15.01.2022 A win for consumers: Financial planners now able to certify documents From today, financial advisers/planners have been granted status to witness a Commonwealth statutory declaration - equal with lawyers, medical practitioners and justices of the peace. This is a very positive outcome for both consumers and planners.... This change follows on from the enshrinement of the terms financial planner/adviser in law. Another sign that the occupation of financial planning is being recognised as a profession. Why it’s so important This update means clients are now able to ask their financial planner to act as an authorised witness in order to finalise and implement documents within a financial plan. This creates a more cost effective, efficient and appropriate mechanism for clients who need documents witnessed. It’s also important recognition of financial planners and the role played in helping clients. They are no longer restricted when it comes to witnessing clients’ financial planning, insurance, superannuation, financial product and other documents. Next steps This change follows the Attorney-General Department’s formal review of the Statutory Declarations Regulations 1993. The new regulation has now been legally registered with a commencement date of 18 September 2018. It will be tabled in Parliament this week and subject to a disallowance period of 15 parliamentary sitting days. After this, unless an objection is tabled in parliament, this change will become permanent.
