25.01.2022 A car crashed into our #Blackburn office this morning and exploded causing some significant damage. Luckily, the driver only suffered minor injuries and no one was in the office. Business as usual for @firstclasslegal as we are all working remotely at the moment. #staysafe

We are not dismissing the public health issues nor suggesting that real estate is any more important an industry than many others which are also currently in an enforced "go slow" or shut down but the right to shelter is a basic human right. 20.01.2022 Pity the poor people who are caught unable to sell (if they need an Owner Builder report for example) or unable to buy (or having to buy blind ie without a building and pest report or without a physical inspection). Not our place to be political but we wonder why real estate is so heavily restricted when anyone can go to an indoor supermarket or market and touch produce and mingle with many other people?? Yes, we need to protect public health and yes there will always be a l...ine with people and industries on either side but surely real estate and some ancillary services can be opened with strict safety protocols. #OpenTheDoor #UnlockRealEstate

18.01.2022 Once upon a time, we needed a Title for our clients sale so the legal firm holding the Title mailed it to us. It arrived at our Blackburn office and sat in the office letter box awaiting the weekly mail collection (as our offices were closed due to Covid19 restrictions). A car ran off the road, smashed into the Blackburn office, exploded into fire and the Title was incinerated.... We knew that we needed the Title but we had been given the wrong tracking number so it took us a few days to realise that the Title was now cinders. Realisation hit at 5pm on Monday last week and settlement was due last Friday. A few #$%@ later and we set to and made the online application for a replacement Title after business hours on Monday. Wednesday we were asked to provide further information which we did and voila, we had a new electronic Title on Friday. Settlement went ahead as planned. Another fairytale ending created by a skilled team who go the extra mile combined with electronic conveyancing. A shout out to the co-operative team at Land Use Victoria too. And they all lived happily ever after The End.
17.01.2022 As soon as we get clarity on what Stage 4 restrictions mean for the real estate and conveyancing industries, well post it here. Premier Andrews specifically mentioned in his Press Conference today that he did not want to stop property settlements being effected and people moving house. We await clarification about private inspections over the next 6 weeks.

During these Stage 4 restrictions, any Section 32 or contract of sale that was signed prior to 11:59pm Wednesday 5 August can action: - Settlement obligations - Bank valuations... - Building and Pest inspections - Final inspections However, for any Section 32 or contract of sale signed post 12:00am Thursday 6 August, none of the above can be actioned. Additionally, they must include provisions for delivery of each clause beyond 13 September 2020. 07.01.2022 Todays announcements are very disappointing. What was presented as a 6 week lockdown will now stretch into months. The roadmap announced today states that the earliest date for private inspections and outdoor auctions (with caps) is 26 October and the earliest date for further easing of restrictions is 23 November. These ongoing restrictions will affect people buying, selling and renting and many businesses that support sales and rentals. ... Well post further updates as they are released. Hang in there Victorians and especially Melburnians. Lucky the sun is shining brightly because these restrictions make optimism very hard to find.

The lockdown also impacts access to properties for valuers, Owner Builder reports, pre purchase inspections, building and pest inspections and final inspections.... As soon as the government has provided clarification, we will post it here. First Class Legal is unaffected by this more severe lockdown - we have all been working remotely since late March but the undeniable fact is that restricting access to properties will stop (or at least slow) property sales in Victoria for a period.

05.01.2022 JUST IN.......SRO news and updates ________________________________________ From the SRO...Further land tax relief for landlords and business owners.... The Victorian Government has announced further land tax relief for landlords and business owners, in response to the coronavirus (COVID-19) pandemic, as part of its extension of the commercial and residential tenancy relief schemes until 31 December 2020. An increased 50% waiver of the propertys 2020 land tax, and deferral to 31 March 2021, for landlords of residential and commercial properties who provide eligible tenants with a 50% or more outright rent waiver for at least three months. Owner-occupiers of commercial properties can obtain a 25% waiver of the propertys 2020 land tax, and payment of the remaining tax can be deferred to 31 March 2021, if they would be eligible under the commercial tenancy relief scheme as if they were a tenant. Commercial landlords who apply for coronavirus land tax relief must continue to provide rent relief that complies with the requirements of the Commercial Tenancy Relief Scheme. If you have previously applied for a 25% waiver and you want to apply for this further relief, you must make a new application through My Land Tax. However, applications are temporarily suspended while we update My Land Tax with the additional relief measures. This will ensure a simpler application process for you. In the meantime, if you havent already, register for My Land Tax. We will notify you by email when you can lodge your application. The Victorian Government also has a range of other tax relief measures in response to the coronavirus pandemic. Heres a short video explaining what it is - unlike "normal" insurance, you only pay the premium once (at settlement) and that protects you for as long as you own the property. The premium is determined by the purchase price but it starts at about $50...0.
